this morning i get a letter thrugh my door off of a debt collection agency called Mackenzie Hall demanding i pay £759 in 7 days or they will take other actions.

 

Bit worried as i had a stupid moment and borrowed £350 off wonga was going to pay it back as i did borrow once

in an emergency as i had my car to pay for but when i did have payday i paid it back right away probably 2 or 3 days later

 

this time i had greedy moment and thought it wouldnt hurt to re borrow

so i borrowed £350 would say i wasted it and got nothing to show for it

 

I kept Wonga updated on my redundancy and my job search to try keep these idiots off my back and

one day i had a 1 time offer off wonga in my email and it said cut the amount you owe us today by 55%.

 

So i clicked it and it said just pay us £400 today which sounded fair to me but once again i didnt have the money to do this as i was out of work.

 

Tried emailing this Mackenzie hall today what a load of junk there website is the contact us page doesnt work and the email on the letter comes back as failed when i try to email

 

Wonga said i would only have to pay £400 to clear the debt but this agency says i need to pay £759.

 

here is what i get when i email the company on the letter

Yes it appears these have bought the Debt off Wonga as it says Wonga is no longer in charge of your account and any concerns must be brought to the attention of Mackenzie Hall Ltd.

 

£500 of that is interest which Wonga stuck on it cant beleive i only borrowed £350 and they stuck £509 interest on top of it.

 

Is there anyone i could phone for advice ?

 

What happens if i make a payment plan with these for £1 a month and they reject the offer i aint refusing to pay but i refuse to pay £759 for something which is 55% interest.

 

If i paid them £1 a month then say i had £400 when i go back to work by saving my wages

 

if i said right ok i have £400 today to settle this debt do you think they would accept it ?

First you must contest the amount on the demand as i can guarantee its heavily inflated with unfair charges.

 

Next you need to spend some time and work out a income and outgoings form so you know how much you can aford to repay.

 

Ignore mucky halls demands. Especially amounts and time limits. Repayments are made according to your circumstancea and yzour terms. Not theres.

 

Also, are you completely sure they bought the debt? As its unusual for wonga to sell the debt unless this is a very old one.

 

Ask mucky hall for priof the debt was sold. Only then offer any kimd of repayments.

 

Also, are you working or on benefits?

If you are on benefits, then you are ok. You pay them £1 a month regardless of what they say or do. If they try and add on more charges, or harass you after you tell them, then complain to the OFT. If they try to take you to court, then the court is pretty much guaranteed to find in YOUR favour.

 

If you cant afford the £1 a month, then tell them you cant pay anything back. Should they take you to court, you can file a defence, which we will help you with, and the court would come down on the PDL like a ton of bricks.

 

The judge will most likely reduce the debt, the payment you make, or in extreme circumstances, wipe the debt altogether. The PDL/DCA knows this will happen, which is why they are trying to harass you for money. However, don't communicate with them by phone in any way, and keep all written communication as evidence.

May I ask..is this a sincerely all singing and dancing 'enforceable debt' - just wondering?

 

Oh and yes............... the DCA in question brought the following to mind..

 

MacKenzie Hall hauled up over debt collection tactics

 

APRIL 21, 2009

 

Debt collection firm MacKenzie Hall has been told to clean up its act.

 

An investigation by The Office of Fair Trading found that "some of its business processes failed to meet satisfactory standards".

 

Now MacKenzie Hall, based in Kilmarnock, Ayrshire, must not pursue a debt where it has been notified in writing that there is reasonable cause to believe that the debt is in dispute.

Ok so i was speaking to a friend today about this stupid debt i have and he said these companies have as much power as a dead rat.

 

There website is absolute joke there is no way of contacting these idiots ive read numerous threads on the internet about them being rude to people on the phone one woman said that she called them after they sent her a letter so she asked what it was regarding and they said it was regarding a debt she needs to pay within 7 days the person said to her are you on benefits she said yes then he said do you have children she said yes i have a son then he asked her haven't you even bothered to get a part time job then he swore down the phone apparently not sure if its true.

 

My friend tells me to do all correspondence by email or letter and send all letters via recorded delivery the only problem i have is the email on the letter bounces back and says cannot be delivered to the recepeint like its a wrong email i have checked it letter by letter to see if its wrong but my spelling is 100% to the letter.

 

is there any other way to get in touch with these id rather not phone them.

Think if you phone wonga customer service and give your details saying you are phoning regarding outstanding account they will say all being dealt with by mckenzie and they will give you mckenzie halls tel no. if you ask for it. Know you dont really want to phone them but perhaps they will

give you address to correspond, or you can at least request everything be confirmed in writing

Do NOT phone them unless you record the call. Email or letter only. If they dont respond to an email or letter, thats their problem. Not the debtors.

Thanks again people i had a reply from this Audrey Stevenson she claims i borrowed £440 off wonga when infact it was only £350 i know this because wonga sent me an email saying i could clear the debt for £400 and pay minimum interest at the time if i borrowed £440 then why would they say i could clear it with £400 that would mean they lose money which i doubt they would.

 

Then she claims the rest is interest totalling up to £759.99 which i claim is rip off intrest but she wants me to prove wonga actually sent me this email which they did saying i could clear it for £400 i tried to login to my account today on there and all it says is this

 

IMPORTANT: YOUR DEBT HAS BEEN LEGALLY ASSIGNED TO MACKENZIE HALL

 

We have sent you a letter to inform you that your debt has been legally assigned to MACKENZIE HALL and is no longer owned by Wonga. To make repayments or if you have a query please use the contact details below:

Thank you for your below email, the contents of which I have noted.

 

My understanding of your complaint is :

That you are unhappy at the amount of interest that was applied to your account.

You state that Wonga.com offered you the chance to pay back £400.00 and the account has now been passed to us for collection.

 

Having investigated this matter I can confirm that the following:

According to the information passed to us by Wonga you initially borrowed £440.00.

The fees on the account totalled £31.00

The interest added totalled £350.94.

You paid

 

All details of interest and charges are contained in the agreement you electronically signed when taking the loan out from Wonga.com and you agreed to these terms and conditions by signing the agreement.

I understand that changes in circumstances do occur, however the issue of an unfulfilled contractual agreement remains.

Do you have any copies of emails or letters that you received from Wonga.com advising you that they would let you pay of £400.00 in full and final settlement? We require to see proof of this before we can investigate any further.

 

If you feel that that £1.00 per month is all that you can afford to pay I request that you complete the attached income and expenditure form and return it along with your offer of repayment. I will then pass it to the relevant department for review.

 

I have also attached a copy of our complaints procedure for your convenience.

 

I look forward to your response at your earliest convenience so that we may resolve this matter swiftly.

Its not up to them to decide repayments based on an I&E form. It's fully dependant on your circumstances. Also, if wonga sold the debt on at a loss, then that tells you something about the debt to begin with. Lets see if mucky hall offer any discounts. If they do, then you know for sure that theres something wrong with the debt.
