FIRE Cabot finacial I have now sent County Court papers

Hello all,

 

Had a debt with a credit card, FIRE (Cabot financial) took over, made a F&F settlement amount with them (got this in writing with dates to pay etc even a letter confirming that when this is paid, my credit files will be updated).

 

Low and behold, last payment took them a month to debit, and no confirmation letter. Default still showing and incorrect amount also showing. 3 months later and no response to letters I have filed at County Court for my monies back, default removed and other costs etc.

 

Check my credit file again yesterday, they have updated, but still with the default, and incorrect balance.

 

Very very angry and frustrated. You do the right thing and they still break a contract.

 

Just looking for some advice. Has anyone else took them to Court? Have they paid up? Do they update Credit reference agencies? Do they actually do whats on the judgement? Will they drag it out or do they right thing and settle?

 

More angry as this is the only blip on a very good credit file.

Did you make an Official Complaint to Cabot and head your letter as such. Did you write to their collections department or Head office ?

 

Did you send your letters by tracked method and have you confirmed that all your letters were received ?

 

This is all information that will be required for you to issue a claim - as you will need to prove that you gave them every opportunity to amend the files as per their acceptance of your F&F.

Thanks for your reply, the way you have worded it, is that I dont have a clue what I am doing, and just frivilously filed an N1 form to the County Court. This is not the case. Lets be straight here, Cabot group of companies are not the

best in the world, they are rude arrogant and theaten at any moment. Some letters were sent recorded, if that is what you mean. I have been in County Court twice, and never asked to prove I sent the letters. Companies do not send letters recorded with the nature of my complaint, however in a County Court, they dont have to prove this.

 

If you read my post you will see that I have given them three months. In that time I have sent six letter and two emails. The only repsonse I got from FIRE or Cabot, was that to discuss the case they need my DOB and my telephone number. No phone number wont speak to you. And they harrass you when they got your number trust me. Its funny cos they cashed all my cheques and when it comes down to honouring there part of the deal, the dont repsond, and still update my credit file with incorrect info.

 

So, for my original request, has anyone taken them to Court? have they settled and done the right thing?

 

I dont mean to come accross rude or arrogant, I am just very very angry with the way FIRE/Cabot have treated me.

To specifically answer your question - I have no knowledge of anyone on CAG taking Cabot to court. Althought that does not mean no one has. It might be worth using the advanced search button - top right hand side of the screen.

 

My reply was not intended to imply that you were either ignorant of the CC claim process or that you were being frivolous. Being a LiP and Claimant at the same time puts you at a distinct disadvantage in the judicial system. It will be you having to prove your claim.

 

I have issued a claim against a bank for non compliance of SAR and I was asked to prove that letters were both sent and received. So just because you didnt have to other times that you were in court - there might just be a time when you do.

Thanks for your quick reply, it all depends on the Judge and on the day I assume. I have been lucky in the past, where I have not even had to speak.

 

I have had a trawl through CAG but cant find anything. I look forward to any replies to this.
