    • Hi there Manager for our soccer sixes team moved overseas mid season and we struggled for numbers so we told the ref about 5 weeks prior to seasons end that we would see out these games then be done and he told us he’d ’pass the message on to the relevant people’. Heard nothing, then 3 days prior to the new season beginning we were given our fixture for that weekend. Told the guy over text we had pulled out and the ref should’ve passed a message on but we were told sufficient notice wasn’t given and it needed to be in writing. I argued it’s not our fault the ref didn’t do as he said but we were countered by the T&Cs.    now being chased for what was £608 kindly reduced to £476 to pay off remainder of the season. Been sent a letter in the post from their accountancy team and told needs to be paid by Friday.   seen a lot of the other threads saying we can literally just ignore everything but im concerned about debt collections and credit score being harmed. Can anyone confirm if this all works/what we should do?   thanks
    • Hi,   I have given an official police witness statement for the prosecution in an upcoming criminal court case, and I am very anxious about what might happen.  Specifically regarding being cross-examined.  My statement is very short, and only a couple of paragraphs long, regarding a conversation I had with one of the victims.  I have tried to research online about what information about me the defence barrister might be able to find and use to discredit me.  I have by no means have a shady past but, I am concerned about what private information might be brought up, and as this is a case that will be in the national press as it is in the public interest.  The two preliminary hearings were reported in the papers.   I have tried to research  online what information the opposition can seek, but it is all very complicated.  I believe that they can legally access public records, but I'm not sure what information public records hold.  Can they access my medical records, educational history, HMRC, and Department for Work and Pensions? (I am a self employed sole trader).  I was arrested once, and this was unfortunately instigated by the victim in this case, so could well be of interest to them.  It resulted in no further action, however I have only discovered this week that that, in fact, this means I have a criminal record, and will be so until I am 100 (no chance)! This has really annoyed me to say the least, especially since I asked him afterwards why he rang the police and he said 'for a laugh'.  So I have started to look into applying for it to be deleted, but again, if anyone has any advice on this I would be appreciative. At the moment, my name isn't on the confirmed list to give evidence, but the detective I have been dealing with has said it is 'likely'. The names of the victims in this case will not be allowed to be reported, are witnesses fair game for the press? I really need no know how deep they can delve in to my life so I am prepared if my character gets assassinated in front of the nation. I really wish I'd never agreed to this.   Many thanks
    • A belated thanks dx. Yes I may take your advice regarding StepChange. I am finding that I am telling them (on behalf of my Son) the true balances outstanding? They never seem to check properly in which worries me. If I was to take on myself is there another way of dealing with various debts? I have already submitted other IRL complaints on his behalf. Today I have received a further response from Quidie T/A Fernovo confirming that they will waiver all interest paid.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello everyone;

 

I have been working for this company for almost 5 years. I had an accident 2 years ago and had my ankle broken and went on a sick leave for about 3 months and i was given 6weeks full sick pay followed by SSP.

 

This year however i needed to have another surgery and had the plates removed from my ankle as they were giving me trouble. I went on a sick leave 4 days before April. And after 7 weeks of recovery i had appendicities and had a surgery to remove my appendix and was signed of for firther 7-8 weeks.

 

According to my employer, the rules for the sick pay has been changed as of April 2012 and they only pay 2 weeks full now. However, as i left just before the change, i believe this shouldnt affect me!

 

When i went on a sick leave i depended on that sick pay. Made all my plans around this amount so i wouldnt struggle!

 

But now i am being chased by my creditors because i couldnt afford to make the payments to those companies!

 

My HR insists that she will have to arrange a management meeting before she can get back to me! I am sure she has all the power and she doesnt need any meeting! Shes meant to have that meeting for over a month now!

 

I am due to be back at work but this problems has given me so much stress, i dont even feel like getting out of the house! My mobile phone has been disconnected yesterday due to unpaid bill! I feel frustrated!

 

I am not sure what to do at this stage! I am not sure whether it is good idea to go back to work while we are in dispute!

 

I dont know where i stand! Could anyone please help me? What should i do? I am sure i am entitled for the sick pay but my employer has been harrassing me long time now! And i have a feeling this is their next trick!

if you went sick before this change on sick pay policy, the change will not, or i should say, will not effect you

 

this change in the sick pay policy,

 

were the staff informed of this change to their contract of employment from april 2012 and what was the exact date

I have receieved no notification about the changes, beforehand or after. It was all done during my absence. They left a paperwork notifying of the changes taking affect from the 1st April 2012 in my pigeon hole while i was away. They didnt even bother posting it to my home address or calling me.

No it wasnt an accident. The metal plates in my ankle were given me trouble and they had to be removed. Unexpected part was that after recovering from that surgery, i had appendicities and couldnt work for further 6 weeks! And everything went upside down as i started struggling to pay bills. If my employer made the promised sick pay, i wouldnt have been in this situation.

If you are fit enough to go back to work then you should, staying off longer will only IMO look bad. just because you are disputing your sick pay shouldnt affect anything else at work, also if they are right (and I'm not saying they are) staying off will give you a longer period of no pay and make your financial situation even more precarious.

I have recovered from the surgeries. However i still have sudden and sharp pain under need my appendicities scar throughtout the day. My doctor sending me off for a ultrasound scan before he can comment on it. Also i am very stressed! My sleeping paternt went upside down. I am scared when i get back to work, i will fail attending work on time for a while, although this is not my concern at the moment.

 

I still dont know what to do! My employer is the only reason i am in such a bad state mentally and financially! Any help on what i should be telling them? How can they expect me to afford travel costs untill next pay day when they cant even pay me the sick pay i am entitled to?

During my research i have come across with this:

 

Unlawfull deduction of wages:

 

Sections 13 to 27 of the Employment Rights Act 1996 (ERA 1996) set out the provisions that protect workers from unauthorised deductions from their wages. *

Protection against unauthorised deductions *

Section 13 of ERA 1996 prohibits deductions from a worker’s wages unless: *

The deduction is required or authorised by statute or a provision in the worker’s contract; or

The worker has given their prior written consent to the deduction.

 

According to this, i should still be eligible for the full 6 weeks of pay. I have been told that from the date of sick leave, i have only 3 months to dispute. In my case, i have only till 22nd July to issue employment tribunal!

 

I have a feeling that they are trying to get past the 3 months period so they dont have to deal with the subject matter!

 

Can anyone suggest me what to write on a letter as i need to start grievence process asap.

Any advice what to write on grievance letter? Any template maybe? Also could you please help me on how to put in the employment tribunal claim?

 

You can get the online tribunal claim and it is self explanatory so do it and as said above it can always be withdrawn if your employer plays fair.

 

My aunt is disabled and they have stopped her pay all the time and she has but in a claim to ET1 to get any redress from her employer. Her employer played for time so she would not be able to put in a claim. After she put in the grievance she wrote to her employer saying that some of her grievance relating to her pay and that part of it needed to be resolved before a certain date as they will understand that she was under time restraint due to getting her ET1 in. But that did not get them moving and they told her they had a time limit to reply, which would put her out of time for tribunal so she went ahead and put in the ET1 to make sure it was not out of time.
