An Update!

 

From the AQ's, the Judge has directed this still be kept at Small Claims - date to be advised.

 

Given how ridiculously inaccurate their Defence was, if they turn up to court, i'll show my bare a**e in Debenhams window lol!

I spoke ot my local court a few days ago Les and I'm expecting the same thing any day now, they did say there is something like a 10 week wait for a date though :(

 

I also rang up the guy who wrote to me recently following the letters from Marc Wilder :)

 

He said in his letter that the ERC was a valid charge and they wouldnt refund it. he changed tack a little when I asked why he was saying the same thing they had said almost 3 months ago . He didnt even know that I had issued on it lmao. He actually ended the call by wishing me luck to which I replied' Thank you but luck doesnt come into it, the charge is a penalty and therefore unlawful and Abbey wont even attend at court.' :D

No change of defence yet but following the AQ, judge has ordered a Small Claims Hearing on 7th March 2007 with 2 hr limit.

Spoke to the Court today. Abbey have appointed a Solicitor for this, but they can't seem to locate the papers :rolleyes:

 

Also, no change to Defence, so i'll laugh my b******s if they turn up to Court with it!

Good News!

 

Letter dated 22nd Feb received today offering Full Settlement and all Court Fees/Interest as they don't believe the costs would be justified at court. They admit no liability (surprise surprise!!).

 

I'm just awaiting the cheque.

Hi Les

 

Well Done!

 

I am in exactly the same position with abbey. Duff defence (defence based on current bank account charges, when my claim is a mortgage ERC & penalties claim!) I have hearing date of 23/3. Allocated to small claims although claim over £7k. Had nothing to-date from Abbey, no change of defence. Did you bother with a bundle?

 

I was planning to pull out but maybe I should hang in there!
