Recently received something similar which i posted about on one of my success threads x yes my letters said the same as the one youve got only they got my name completely wrong x so i had a few options a prove it letter or return to sender as this debt was most definitely not mine x think these guys are trying it on with everyone cripes in the recession they must starving to death.....shame they couldnt do it quietly elsewhere :-) lol x good luck with yours x

Then it is only £280 you owe, less for charges and fees and subsequent interest.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Just to clarify - is it put into "dispute" from their actions or do i have to write and state "in dispute"? Reason i ask I didnt write and tell another company and they have denied its in dispute to another DCA they have binned the alleged debt onto.

It can be modified, but only one DCA is allowed to chase a debt at any one time. And if the debt is in dispute, it must be passed back to whoever owns it.

Thanks for the link but what i meant is dca 1 failed prove it letter so i ignored. Now dca 2 i have told this is in dispute with dca 1. Dca 2 write back with... Dca 1 says there is no dispute so cough up money... So i meant was.. Is dca1 claiming its not in dispute because i didnt reply and spell out its in dispute? Or should they full well know its in dispute without me having to tell them. Ta

yep. just put the account in dispute. The First DCA will need to PROVE it isnt. Not just say it isnt.

I see. In fact my last letter states to dca2 that its in dispute. So do i need to write to dca1 again ? I knew id goof this up some where lol

No, just tell DCA2 that as far as you are concerned the account IS in dispute as DCA1 failed to supply any evidence to prove you were liable for this account, if you don't want to send it recorded delivery, why would you? just send it 2nd class post and get 'proof of posting' from the PO counter, which is free.

 

Keep in mind that these are simply uneducated DCA's, who have absolutely no legal powers whatsoever, so all they can ever do is send you puerile letters.

ok all,

 

well i discovered on my CRA file that there is a discrepancy with my address for this so called catalogue debt

 

i will use for example purposes, Flat27, 6 Example Road, where as my CRA says Flat 6 , 27 Example road. I disputed this with the relevant CRA And they have removed the disputed entries.

 

I have written to littlewoods extra to find out more about this. It could well be that a catalogue was sent to wrong address and run up a debt.

 

Since DML are asking should i notify them this info or just leave it with littlewoods to deal with?

Deal with the OC. Ignore the DCA. If the DCA tries stamping their feet, tell them to shut up and bugger off, as the problem lies with the OC. Not a lowlife DCA thats acting only on behalf of them, and simply want their share of a debt that doesnt belong to you.

Littlewoods would not work with me on this at first. Trying to palm me off to pheonix credit who have never contacted me about this. Told them possible fraud on the acc and im pretty sure i paid them off. I had to escalate to complaint level to be told they have no recorfd of me as over 6 years ago and told me to contact dca for breakdown of charged. I requested a letter be sent to me stating they hold no records that a debt exists in my name for any amount the dca claim i owe. Wonder if they will play ball? Last payment i can see was 2005 although default placed by arrow global is 2007. i would say stat b... But i want incorrect default removed. So what next? Ta

Quick question. If littlewoods have no details regarding myslef on their systems and the default is in name of arrow global. Who should remove this default? Or should i just dispute it via the CRA? Thanks

Wait. last payment in 2005 makes the debt statute barred. if they put a default in 2007, 2 years after the last payment, you need to write a verysrong complaint to their compliance manager. Defaults must be recorded within 6 months of the action that caused it. That means the default should have been added 6 months after the last payment at the very latest.

Hi Renagade. cheers for you help

 

i mistyped the default date above sorry - default is 2008.

 

now littlewoods say they HAVE found an account in my name! even though they argued blind they didnt have any since 6 years have passed and that all they keep them for.

 

they say This account was transferred to the Phoenix Collection Agency XX.06.2008 with a balance of £4XX.XX and have cross checked the default which says XX/06/2008 The period from default to them giving/selling to Phoenix is EIGHT DAYS... This seems a little suspect to me, for one i had no notice of default and two the default is for £280 and now littlewoods tell me they passed it to phoenix as £4XX.XX

 

Also i cross checked the account number that has just been quoted to me against the one filed with default and thats totally different too!!

 

This is driving me crazy.

 

Again they notify the so called account was at a SIMILAR address not my actual address - so this is incorrect. I advised them already this is wrong and could be frauded in my name.

 

They say they are now looking into "archives" to find purchase history to see if i paid in full before i moved property.

 

So default amount is DIFFERENT to what they now tell me.

 

Default to debt sold = 8 days and not been given any notice either.

 

i am trying not to swear right now...

 

but what should I do now? this is getting stupid

The default must be added within 6 months of the last payment/cause for the default. It cannot be added years later. As Boo said, find out the exact date of the last payment on the account that you made. 6 years from that date, and the debt is statute barred and youre in the clear.

Yes exactly, then you can go after the CRA and the foolish DCA for compensation if they fail to remove the inaccurate adverse data.

this is STUPID! littlewoods say it was sold for over £400 and the default is £280

 

my bank statements say 2005 for payment - but i will double check in case i have missed any. I may aswell request when littlewoods reckon it was too. They are getting a VERY lengthy email right now.

If your bank statements say 2005 then 2005 it is.

 

Send them the SB letter, it is up to them to prove it isn't.

 

If they then come back with the standard fabricated payment con, then will be the time to SAR them.
