      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HI, ive been paying child support for my son and daughter for 10yrs now, my son is 16 and daughter 15, recently my daughter moved in with me and is at school i have paid privately without csa, but soon as i asked for £5 a week off my ex wife for my daughter she went up in arms and decided to go through the csa, my son is 400 miles away, and i travel 264 miles per week to work, ive heard of variations, so i need advice, if she can be funny so can i, ive paid all those years, all the travel costs to see them in that time,no help from my ex and i ask for a fiver as she is on some benefits or other..how tight!

I think your wife may say that , as you have a kid each , that would be fair to her. If you then end up with your son , when he reaches 16 then YOU go through csa and get the money from her , she will have to pay it aswell , will be easier too with her being on benefits ! Good luck i hate people to try to dodge csa , in my case i have had years of it.

She has to pay now jacob, ive done everything by the book never missed payments, always compromised when she has demanded more. ive read horror stories about the csa and she always ued that as a sort of blackmail, iam a parent with care, she is a parent with care, does she have more rights bieng a woman...i dont think so, they all slag men off for not paying, well here is an example of a woman not wanting to pay and i think personally on the whole if it were mainly women who were the absent parents they would be worse than the men!

I agree , my x hasnt ever paid for his kids , even when one died , he has had 15 addresses in two years ! MEN and WOMEN who are care givers should be treated equally, but it usually always falls to the women being on the end of this argument. They are good for nothing, and the fathers that do stay put and lead a productive life always get it stuck up them ! because of the fathers or mothers that dont pay, or like my x WONT

Well ive put my payslips in now and the csa want more than i can afford...that means im struggling to put fuel in the car to go to work..im packing the job in bugger it, she wasnt happy with what i was paying, shes even depraved her own daughter, unfortunately if you work these days you are worse off than the lazy **** ex wives who dont like work, shes on benefit and can run a home..i work and cant meet the costs cos of the extra payments...hope your happy Ann youv just put your own daghter into poverty you should be proud and for the csa! how do they manage without their script! what a bunch of numpties not a brain between them, replace them with burger flippers from macdonalds and do the job properley!!

You should make an appointment to see a solicitor on one of their free sessions, there might be something that can be done.

The csa are useless ive had them chasing my son dad for 4 years to which theyve only just recently took a deduction.of earnings order out to which he then finished his job so he didnt have to.pay for him. You should hold your head up high that you have always been willing to pay for your children, at least ur kids know u care and will think highly of u as they grow older.

Worst of all i pay my other sons mum a fixed sum every month..yes ive had 2 relationships.. by way of family arrangement i also help with clothes pay his xbox live etc, but the csa wont accept this therefore i have to pay 15% to my other ex, so in respect iam now paying more than 25% for 2 children, so now i have to put him through the csa to get it down to 20%, so thats another relationship going all clinical and by the book and on top of all this my daughter also my exs daughter by the way is feeling the tension from me, what kind of mother throws their daughter out to suit the new boyfriend, i rescue her off the street give her a stable home and then she wants more money to cover the shortfall now she only has one child to claim for..what a woman, a very self centered selfish woman who should hang her head in shame,..ive a good mind to hold off payments and go to court, represent myself and tell the judge whats been going on at least he or she might listen not like the csa. it really confuses the csa when the pwc is putting a claim in to another pwc, they dont know what to say when i asked ..are you concerned for the welfare of the child?..she replied yes..i replied back what about the welfare of our my daughter? also her daughter who is putting the claim in?..her reply...err erm..err....EXACTLY! like i said in my last post, they are lost without their script..bring on the burger flippers!
