Hi.

To put this in a nutshell, I've received a letter that tells me their intent to take me to court for £270.40 and also a repayment plan they'd like me to adhere to if I don't ignore the letter.

Now I can afford their repayment plan, but 2 weeks ago my debt was £150.40 and I sent an E-mail to them offering to pay in full on 28th June despite not wanting to because I'm in a DMP but just want these sharks off my back.

 

Any advice?

If I had a leg to stand on in court I'd go, especially as I made an offer of a full repayment.

We're going to need a little more background info to help you out. Could you elaborate a little? Dates, amounts, overdue time etc.

I took the loan out in january £250

And was to make subsequent payments of as follows;

27/1/12 £107.50

28/2/12 £122.66

28/3/12 £198.75

28/4/12 £81.40

 

I didn't pay in the month of April as my loan repayments were more than my wages and every month I was retaking out loans to pay loans off.

Worst thing is I paid all my debts off in January but was left broke so needed to lend again and I spiralled out of control once again.

Looking at this I feel I have paid my Debt plus a fair amount of interest and their effectively chasing me for interest.

Which I'm not sure is legally enforceable?

I've got until the 6th July to make a payment/decision.

They're chasing you for contestable fees. What they do is get you to pay the loan plus interest but then try to say you owe them more. Even though you don't. Its what is known as Cash cowing . One they have you, they'll milk you for as much as they can.

Well I have until the 2nd July to make my decision on whether to pay.

I reckon the court would go in my favour.

I've made attempts to pay, I'm with Harrington Brooks on a DMP (silly I know) and I've paid their fees and now money being paid to them will pay my creditors plus their fees.

And also offering them the amount they wanted 2 weeks ago when I got paid even though I'd be struggling for the month.

 

Personally I'd like to go to court and see what is done but I do have abit of a mouth on me when challenged and end up wanting transport costs and a days wages in contest for a waste of time.

But the other hand says pay them and they'll go away.

What you need to do is secure your money. The easiest way is to create a new bank account with a completely different group of banks, then use the new one for your day to day money, and the old one for bill paying.

 

If you decide not to continue paying the PDL, then you must write and tell them that the permission to debit your account is now revoked, and you need to write to your bank to tell them to cancel the CPA on your account, and you must cancel your debit card and get a new one.

 

Have a read over some of the various threads on here. You'll soon see what the PDL's are doing, and for some reason, a few banks seem to let it happen.

I've already opened a new account a few months back. I've been looking for help within these forums for awhile now and they've really helped a lot.

This one loan is the one that is getting me down. The rest of them (and I have 6 payday loans) seem to be fine to deal with.

I just need to know what im up against with the obviously contestable charges and whether I should fight this or back down and keep being a cash cow?

Thats up to you. DO you want to pay the what you actually owe, then go your separate ways and let them do it to more people? Or do you want to fight them, and bring it to the attention of the OFT/FOS or even the courts, and make some way towards stopping them doing this kind of thing altogether?

 

Unfortunately most people choose the former way of dealing with it, and in doing so, you have the situation you are in now.

I'd like to pay them what I actually owe but they just want more.

I'm confident I could go to court with this with my head up high and fight this one.

I think I'll take some time out tomorrow to call the OFT, the FOB, CCA, BCCA and that MP Stella I've read about and outline the problem I'm having with this loan shark of a company.

I've wrote them a stern email, and used your term "cash cow" and how I plan on complaining.

 

They quickly replied and offered me to pay the 150.40 as a final and full settlement. Which is what I originally wanted to pay.

Good job. Notice how when you call them out on their business as well as the charges and interest, they miraculously seem to be able to remove them? That proves beyond any doubt that the charges were unfair and unenforceable.

 

Before you pay it though, please make sure you get in writing, that the debt will be fully settled, and any suppossed remainder of the debt will not be sold or continued in any way, shape or form. It's not unusual for a PDL to settle for a lower amount then a year later, sell the remainder to a DCA. If you have it in writing that they wont do this, then you can breathe a sigh of relief as another weight has been lifted from your shoulders.

Thanks for your help today. It gave me the boost and and the "I don't give a damn" attitude I needed.

Though I shall still complain as the whole debacle is clearly wrong.

Good for you. You should definitley make a complaint as you were treated unfairly and they tried to extort money from you. Hopefully your issue will be taken onboard by OFT, FOS etc and help in future investigations.

 

Make sure to contact Stella Creasy too as she seems to be the main MP trying to shut this "industry" down. I think she would be very interested to hear about what they did to you.

next i knew was the court safeloans are muppets, they issue ccjs left right and centre, i had one from them 100 initial debt which became 350. they never wrote to me or anything, letter telling me about the arressment. looked on experian and the [EDIT - PLEASE REFRAIN FROM PERSONAL ABUSE]s have 5 seperate mentions on it, 4 defaults and a ccj. *******s. paid it and left it at that, credit reports are tosh unless you dont have a mortgage.

If they added multiple defaults for one debt then that is complainable and you could be i line for compensations.

 

Also credit reports are used for a Lot of things. Not just a mortgage.

im aware what credit reports are used for but the only thing you should have to pay off is your house. i dont have any more of that 'never never' crap. dont even think these credit report companies are regulated. to me its all bull ! if you cant afford it now then dont get it, or save up. thats the way to do it !
