    • Do you have historical meter readings from before the meters were changed? And more recent history showing consumption, in metered units not in £s,  since the change. One specific thing to check is gas. Check that the meter and the bill use the same units. If the meter is recording cu.m but they're billing as if it was counting 100 cu.ft, then your bill will be nearly three times too high.  Overall I'm guessing it's an Ovo screw up. It's significant that they didn't block the transfer, maybe they aren't so sure of their position.
    • Hmmm, interesting point. In my career, that I am retired from now, there were an immense amount of rules and regulations that one had to adhere to by law. The qualification process is rigorous with on going assessments throughout your career and re-certification every 12 months. If you were shown to be not competent in those rules and regulations you could not hold the position and the operational consequences of that could potentially be dire. In the same respect, perhaps a judge who is not conversant in the rules of POFA should not sit in on cases that requires proficiency in that area? I also bow to your considerable knowledge in this area, perhaps I shouldn't be commenting but by doing so I find it helps the learning process. Your last point has just reminded me of something that may help my case, thank you.
    • Just had an email re the my breache in agreement by her rep.   I asked you yesterday if they had asked about her name in the thread being removed.   The issue they have is the Elizabeth turner and genetic pups entry on google.   they knew I did not put it up and told them so in court.  I dnt know how to post on google.   I told them I cannot remove what I did not post.  when i come back here and saw her name gone from threads title, I presumed her reps sought it.   now I get an email saying her names still on google ur breaching the agreement as it’s still on google.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello

 

When I took out my first mortgage in 1997

I was told I had to have payment protection insurance and now believe this was mis-sold.

 

The company who told me I had to have the insurance was Berry Birch & Noble who have since gone into administration

but the policy was with Legal & General.

 

I have tried writing to Legal & General twice about this and have tried calling them but can never get through to anyone who will discuss this with me

and I've not received a response to my letters.

 

Do you have any advice as to who to contact at Legal & General

or am I best going to the Financial Ombudsman as I believe they have a fund set aside for people who were mis-sold PPI

through a company that has since gone into administration?

 

Any assistance you are able to give would be appreciated.

Have you got a record of all of your payments and your policy number?

 

Is this still running and being paid?

 

What did you send a completed fos questionnaire and did you send your correspondence by a trackable method?

Hi

I have got a record of my payments and all the original paperwork and policy number.

 

I did stop this policy in 2003 when I sold the house and paid off the mortgage. Because it was so long ago that's why Legal & General on the telephone say they can't look that far back to trace the policy. They said send a letter so I did but I didn't send a FOS questionnaire nor did I send it trackable so maybe that's what I should do.

 

Originally I thought because I stopped the policy in 2003 this would be too long ago to make a claim but I understand that I just have to lodge a complaint within 3 years of first becoming aware that I may have grounds for a complaint, hope this is right.

Yes you are right on all counts.

 

If you have the policy number and all the original docs then L&G can't back out of this. They may not have the documents but you do so you can produce the evidence.

 

You can use this spreadsheet to help you work out what you should get back.

Ideally I would send L&G a completed fos questionnaire and a copy of the spreadsheet and, if you can, send it recorded.

i have tried looking but still cant see either an email adress to ask them or an adress that i can send my forms too. want to get the right place as to not waste time. sorry if im being real slow here and missing the obvious...

yes i have seen that but still unsure. my ppi insurance was with legal & general but my mortgage was actually with nationwide. it is l&g im complaining about but in the link you've kindly sent me the section for mortgages is for existing customers only with a bank mortgage with l&G! I cancelled my policy about 3 weeks ago after being with them for 4-5 years

i did as you said and just got a reply back today off NRAM (northern rock assest management) saying....

 

'thankyou for contacting NRAm. i am sorry to hear of your dissatisfaction.

your letter suggests you wish to make a complaint, however, the insurance was sold by legal and general and not by NRAM. Therefore, we are unable to assist you with your claim.'

 

At no point have i ever dealt with NRAM or sent them any paperwork! Do youknow of anything thats happened like this before? also what is the cut off point for making a ppi claim? i noticed about 2 months ago, cancelled by DD for ppi insurance straight away and have since sent the letter to them (or at least who i thought was them) possibly a error by royal mail? bit of a strange one!

thats strange NRAM have been writing to people actually advising them they had PPI and refunding it.

I've e-mailed l&g again asking for the exact address! You don't have an address yourselves then that you can reccomend to send it to? or anybody else reading this? gets frustrating when you go to the trouble of filling in the forms and sending away only to get a reply 2 weeks later off somebody else saying its gone wrong place!! Thanks

Hi, it's some time since I last posted on this one. I've been trying to get a response from L&G since last May. Have finally received a letter (after emailing their CEO) that says becasue the plan I had with L&G was taken out following advice from Berry Birch & Noble (who have since gone bust), they are not responsible for the oversight of the advice and therefore I do not have a PPI claim with them.

I've also contacted the Financial Ombudsman Service but they told me to contact the Financial Services Compensation Scheme. The Financial Services Compensation Scheme say I cannot obtain any compensation from them as the claim is prior to 2005.

I'm wondering whether I should now give up or whether L&G should actually take any responsibility for the misselling? Any advice anyone can give on this issue would be appreciated.
