Abbey have told many of us that they don't have our statements or account data and are not required to hold them more than six years.


A thought has occurred to me, they say that after 18 months or so that all data is transfered onto microfiche.


Well each microfiche film holds something like 500 statements from a given month (don't ask me how I know, but I have this on good authority, the number may be slightly different but the principle is right), and I'm guessing that for most of us our statements will only consist of one or two pages per month.


what this means is that in order for them to get rid of our data as it ages, they will have to destroy the films that hold statements that are no longer necessary but still maintain the data for those who have existing accounts.


In other words it seems a logical argument for challenging the age of data they hold.


I know many will have had the letter saying 'we are not required to hold data for more than six years'.


My response will be I am not interested in what you are required to do and I require my statements.


Now don't be fooled into thinking that any clever argument is going to make them send you the data. Unless the ICO announces that Abbeys system is relevant they wont.


What it will do is make it difficult for them to provide the data at some later stage to refute your estimated claim when they have told you not that you cant have it, but that they haven't got it.
