A wee update,

well, it's all go go go.

I honestly don't know what I was doing with my time before I found all of you.

I've gone all technical and can now navigate my way around my scanner...

..I've only ever used it as a printer.

I've spent lots of time on the blower tracking down those who may have documents relevant to my case lurking in their archives,

but more importantly, sifting out those who don't.

It's been a really worthwhile exercise and for the most part,

the people I have contacted have been really approachable i.e. the Sheriff Court were very helpful and offered good advice.

I've sent off SAR's to RBS. Nat West and Anderson Fyfe's will be mailed tomorrow.

Hope the sun shines for you all tomorrow. Cheers G.

Hi,

Many thanks to all for your help last week. I had no idea where to turn. Your direction and advice has been priceless, All SAR's are out now, hopefully they won't go dragging their feet for too long and I can cross referencing and make some sense of why there has been so much confusion over the last 3 years. I be calling around to clarify some points on Monday and will keep you posted on developments. Have a good weekend. Cheers G

Great. Well done.

I think that it would be very useful too - essential, in fact if you start working on a journal of events. I think that you need to have the whole story down on paper set out chronologically.

This will be important if you have to go to court and you may as well start doing it now.

It may be painful - but you may also find it therapeutic as well.

Well... doesn't need to be concrete. Ordinary paper will be fine.

Hi,

I’ve been working on a diary about RBS Loanguard which I have had a 3 year battle about

and having trouble with the whole timeline thing.

Everything seemed to happen so fast and take me over, but when I was looking at court papers etc last night from 2009

I was thinking why didn't i deal with that sooner?

Maybe I was just not very well (in the head) ha.

I went tearing through boxes etc this morning totry to jog my memory.

I know I should be concentrating on the RBS stuff, but this jumped out at me and rather than put it aside

I thought I'd run it past you, should I follow this up?

It looks like I had insurance once again and they have denied it, but hey, what do I know.

I have found paperworkrelating to a loan from Lombard Direct which was one of my RBS Direct Debits.

1/ (21.11.2008)Letter from Lombard noting receipt of my claim form. (Unfortunately I don’thave anything from them actually disputing insurance cover)....but

2/ (14.09.2009)A letter from Eastwood & Co. Solicitors demanding payment of loan (I’m assumingthey disputed insurance cover)

3/ Whilerifling through an old box of random papers I found a letter from LombardDirect dated (02.10.2007) it looks likeI requested a settlement figure on the loan (Loan Account Numbers match)....maybethinking of paying it off, but clearly changed my mind. It shows:

Currentbalance on Account £1748.80

Less: Rebateon Loan 98.74

Rebate ofInsurance premium 83.87

182.81

Amountrequired to settle the loan 1566.19

They seem to be offering me a rebate on insurance,

which they disputed existed when I tried to claim.

Maybe I'm wrong, but hey, they seem to have RBS connections, and nothing would surprise me.

The balance at the time I tried to claim was £159.30 and was paid off in instalments last one 01.09.2011.

Thanks

G

Amazing that you may have had two PPI policies in place and each case, the insurer declined to pay out.

Seems as if - if they don't steal you money by misselling, they take it by not paying out when they should,

So you are saying that they quibbled over a claim of £159.30 - and they are conected to RBS.

I think that you should begin by information gathering. It is always the best thing to do - to be completely prepared and fully informed. Then you can attack them with confidence for proper compensation.

I suggest that you send Lombard an SAR and also the solicitors.

See what it all brings back.

point her here we'll get it back!

as for concrete letters

you dont have to post your letters

the 'door-step' colletors will take them along with your 'concrete' doorstep!!

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Yes, please do that. Post a message that you are having similar problems.

I have put up a message but they may not publish it if they don't want to send traffic to this site.

OK. I have made contact with the doctor who wrote the article above and whose experience with the RBS is very similar to yours.

She has replied to me and we may speak tomorrow.

We'll see how it goes. I am sure that it will help to have others who are in the same boat if we do this together.

It turns out that you both live in the same town - that is a good start

A wee update.

I contacted Nat West RBS Insurance who have now given me a Customer ID Number attached to the Overdraft Loanguard

(apparently they do not deal with 'Policy Numbers'. Insurance was taken out in the year 2000 and was cancelled 6.7.2009

- their system shows an Overdraft Loanguard payment of £22 for July 2009 and similar payments historically.

Tthe reason my branch has given for cancelling the policy (which Nat West have on their system) is that 'I had stopped paying the premiums'.

Confused?

you will be........honestly!!

you couldn't make it up.

Now it's a waiting game for the SAR's to start kicking in..

...and to think,

last Monday I didn't know what a SAR was. G:roll:

Hi Gerri

Were they prepared to put any of the detail in writing [cancellation] and did you record the call?

It may be prudent to not draw any further attention to the matter until they respond to your SAR, RBS are a shambles at the best of times, if you give them the heads up of your intent they may not be so forthcoming in sending unredacted data.

Hi Phil,

No, they won't put anything in writing......data protection apparently. I believe you may be right about about keeping my head down. I'm sure they must be saying "oh god, that crazy woman is back"!! Hopefully the SAR's will throw up something that will maybe make some sense of the thing that is RBS.

Dear Gerri,

I wish you the very best of luck - the advice you are being given are the small steps to becoming empowered :)

Just like you, I had no idea about what a SAR, DN, CCA, let alone a POC were but the most important points to remember is start creating a paper trail, as opposed to telephone calls. Make sure you have marked on your calendar when the 40 days are up following your SAR request.

Try and read around different threads and learn from the experiences, it can be quite a journey but post up whatever you feel or need to ask, it is all worthwhile in the end... I have spent many an evening (which ended up being all night on here) to get a heads-up or a glimmer of wisdom.

Good luck and know you have made some fantastic connections on here that will help you along the way.

If you do find yourself having to respond to a telphone call - you should always take notes. Then immediately the call has ended write to the Bank/Whoever saying something along the lines of..

In respect of a call from/to your office today - please find below my understanding of our conversation.

Thank you for your encouragement......you are kind. I've been so lucky to have found the forum. I do believe I was at a point where I was giving up the fight.....had no more to give. Last Monday I was still at square one with the whole issue after over three years. By this Monday? everything is posted out and now (I feel like a wee freight train) I'm just waiting to chase up SAR's and cross reference when the data starts arriving, that should make for interesting reading. It was suggested to me today that I could possibly write directly to the Sheriff Court, tell all and ask their advice......brilliant idea!!, flag it up....... never would have dreamed of doing that. I've been working on a letter to the court which I'll post on thread tomorrow.

Cheers

G

I think that it is a good idea to write to the court. However you wouldn't be asking their advice. Rather, you would be writing to point out the injustice and asking them to re-open the case.

The court won't give advice.

Be prepared for a disappointment. The court may merely tell you to seek legal advice. On the other hand they may do more.

A shame that it is in Scotland. If it was in England and Wales, it would be very easy to apply for a setaside - even this far away from the date of the judgment.
