Hi there,

 

My mother had an iuc with dwp in 2003, just wondering ifanyone knows how long the recordings are kept for.

 

Just to add dwp have no records of my mums 2 compliance investigations which were previously carried out, they have lost the files or they have been destroyed.

 

How do I go about requesting the recording?

Don't bother. It will have been destroyed a long time ago.

Someone please correct if if I am wrong, but my understanding is that dwp keep 2 copies of the tape, one which is kept in the file and I assume has probably been destroyed or lost with her file. The second being the so called master copy which is kept separate. Will this one be available

 

Just a bit of background as to why I need this tape. My mother in 2003 was seen by compliance where she declared her savings, the same happened in 2006 but no interview, then again in 2007 she was seen by compliance again no interview. Finally on 2010 her benefits were stopped dwp claiming she had exceeded the capital limits. Initial overpayment was £24,000 yes you read write. Managed to get it reduced to £11.000 and finally down to £6000 for the period covering 2004 to 2006. I want to argue that all her savings were declared at the interview in 2003 and dwp have failed to act upon the information they were given which clearly at that time was over the £16.000 therefore the the overpayment has been as a result of an official error.

 

Literally it took dwp from 2003 to 2010 to calculate an overpayment.

 

Although the dwp have now admitted that they were wrong to stop her benefits in 2010 and mother is now awaiting a back payment of income support for 2 years, which she has been promised she will get by the end of the week.

You are correct - the working copy and the sealed master copy. As previously stated, unless there was a prosecution and I have presumed there wasn't, both would have been destroyed.
