    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Okay Filed A Claim which they have acknowledged and wish to defend. I knew these buggers would be difficult.

 

They did originally offer me half, and Ive kept that letter even tho they deny it's unfair.

 

Has anyone had any success stories with Barclays, coz Ive not seen any??

 

I am waiting now 28 days for the defence.

 

Has anyone got passed this stage yet.

 

I will be back with my success story or with what to do next.

Well reading deeper on this forum looks like they are just going to be a pain. Im gonna go all the way tho and see what happens.

 

Hopefully I'll get the money just when I need it.

 

Just so everyone knows.

 

I basically sent a letter from the forum along with dates and amounts of charges.

Then another letter more or less the same stating that they didn't reply in time so this is thier last chance attached same list as above.

 

Filed a claim online.

Recieved the acknowledment of service which I really wasn't happy about

 

Now I am waiting for either a nice refund by 02/11/2006 or a defence the day before is what the usual practice seems to be.

 

Just wish I could send the heavies around and break some legs...

 

Anyway. I will keep you all updated and it you have any info for me please let me know.

Hi DJH, just seen your post in another thread and now can answer thoroughly.

 

If you used MCOL, then add five days on to the date filed, that is the deemed date of service and that's where the time starts ticking. 14 days from then is the deadline for them to acknowledge. Now that they have acknowledged your claim, this buys them the whole 28 days starting from the deemed served day. So, from the day you file, it's 33 days.

I'll wait. It's just ridiculous that they have decided to follow this procedure. They have billions in the bank and they are just greedy for more.

Not that I mind going to court at all

 

But.

 

With Barclays has anyone actually had to go to court to defend themselves or have they paid up or backed down before that.

 

I know we all have to go thru the same laborious defence and waiting game but not heard much after that..

 

They don't make it easy do they, but it's all fun...

I am now waiting for the standard Barclays defence on 1 claim...

 

Can I Issue a 2nd possible even a 3rd Claim.. Should have done it in the 1st place I know.

 

1. I didn't claim interest, so just waondering if I can raise another claim to gather these costs upto the date that I actually get (if I do) my money.

 

 

2. I asked for the last six years but I think they just give me four. So I am thinking, now I am on roll and after the way they handle all this of making a further claim for the missing 2 yrs.

 

Im with the rest of you and they can no longer be allowed to get away with this.

 

These bank charges in the past have left me in financial dire straights, always catching up each month.

 

NO MORE..

You CAN'T lose.

 

Yes, Barclays will be awkward and difficult and will try to delay things at every stage possible. But unless YOU choose to give in (either to their hollow intimidations, or to accept one of their derisory settlement offers), you will get your money.

 

I'm surprised you haven't seen any success stories yet - there are plenty on the forum, and in the "Bank Charges Survey Results" (at the top of the page).

 

Barclays can't win because they never go into a court hearing.

What if when they offer final settlement I still decide to go to court??

 

I know they can just not turn up but do they get something issued agains them like we the public do CCJ's e.t.c

 

I am apalled by thier behaviour and want some additional justice even tho my claim is not that large..

If they offer the full amount of your claim unconditionally, then you MUST accept it. And once you have accepted it you CANNOT go to court.

Okay.

 

As expected they have now filed a defence. Can't remember if it was on the deadling or a few days before. I just forgot about it coz I knew this was coming.

 

So for others the standard barclays procedure is:

 

Send the letter with list of charges / dates.

Get half of what you are owed offer from barclays.

Send another letter for the full amount with list of charges / dates.

File a claim on MCOL.

Wait for about 2 weeks.

Get an acknowledgment from Barclays.

Wait again the full duration since time claim was served.

Day before or around about they file a defence.

 

Next step I think is filling out a few forms and from what I have heard and hope they pay up or better had otherwise I be off to court melawd.

Court Date Given for Feb 20th

 

Does anyone know what the standard procedure is here. Do they go to court normally. Do they, pay up before court. Do they fail to turn up e.t.c Do they just pay money into the account.

 

I am sending the documents back that I need by 5-10th of Jan 2007

 

If anyone knows what the usual turn of events is Id appreciate it.

if you have a court date you could try ringing them to ask for a settlement.

the number is 020 7116 4532 and you need to speak to rebecca connely or anthony lombardy.they may decide to settle or wait till nearer the court date but it's worth a try ,what have you got to lose.

you will get your money eventually.

If Anyone is interested.

 

Just attempted to ring the above numbers but went to answering machine. Another number I tried was 020 7116 5634 Think the lady was called Tammy or Temi and will confirm this next time I badger her.

 

She seemed to be dealing with it and not Connely or Lombardy.

 

Said she has not had a chance to look into it yet and Ive left my details.

 

Will be calling again soon if I do not hear anything...

A friendly word of advice - Don't badger her or any of them. They have a job to do and they have nothing personal against you. They are doing as they are told.

 

If you, or anyone else, starts giving them a hard time not only will they probably make you wait until the very last minute but they will do the same to others in the same position as you and who may be quite desperate to get their hands on their money.

 

Calm down. It will come.

No Problem.

 

Ive just sent in my documents for court. I called last week and she hadn't looked at my case. They have until 12th Feb to submit documents they rely on in court e.t.c So I am going to leave it now until towards the end of the month and call back.

 

Hopefully because the date is looming they may know who I am then and I will get more of an answer but that will be the amount of my badgering.

Okay.

 

They had until today to file thier stuff for the 21st Feb. Gave them a call, should have done a few days ago.

 

A nice guy called Charles Spalding, who is handling my case. Temi has left is in the process of faxing over an agreement for my 845pounds they owe me.

 

Not a success story just yet, but should be by the end of the day..

 

As Bernard Once Said.....Boooootiful..

 

So to all you others. Hang in there. It took me about 3.5 months all in all I think...

 

Who Do I Contact to make a contribution for all the fine help...
