    • Back to octopus from the smart meter/tariff salesperson. Octopus have now said just ignore the letter - I dont have to have one despite there letter implying (at least) it was required, but that i will HAVE to have a smart meter if current meters stop working as 'their suppliers dont supply non smart meters any more'. They also say they do not/will not disable any smart functionality when they fit a smart meter I am of course going to challenge that. Thats their choice of meter fitter/supplier problem not mine
    • Point taken that we should inform new Caggers that the £20 option is there in wrong registration cases.  Well, supposedly there, who knows what the PPCs would do in practice.  Anyway, the option is allegedly there with both the BPA as you say, but also the IPC (I've just checked). However, there's a danger here of baby, bathwater. The two easiest types of cases to win are (a) residential - due to Supremacy of Contract and (b) wrong registration - due to "de minimis".  Indeed until recently we has been boasting that no Caggers, over two years, who had sent a PPC the wrong registration snotty letter, had even been taken to court, let alone lost a court hearing. We simply can do nothing about a terrible judge.  The judge seems - I say seems because we haven't had all the details - to have ignored "de minimis",. got fixated on a sign and awarded unreasonable behaviour costs.  A totally bizarre judgement.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

 

quick line to let you all know the airdrie savings bank paid my wife

£759 I think she said over the phone.The date for the hearing was next

Thursday,but a letter arrived today saying they don`t admit liability,and they are

closing her account in the next month.Thanks to all you guys who helped me on this

site.And I will make sure the missus makes a donation to this excellent site

well done! the airdrie saving bank are terrible for there bank charges! i have been a customer of theres for over 20 year and im sick of it. hopefully ill get a good reponse like yourself.

Good luck! Just make sure you have a parachute account if they have started closing people's accounts in retaliation.

 

Would the OP's wife perhaps have a claim against them for doing this too, given that A&L have been fined for retaliatory account closures?

SO SO GLAD TO HAVE FOUND THIS THREAD!

 

I have also been refused and will take it to court. They owe me £2500.00 in charges.

 

Have set up a parachute account yesterday and will be applying to the court this week. So thanks guys for giving me the confidence now.

I'm so glad I found this I have been looking all over for something about ASB. It's actually for my sister she is a single mother with two children and gets her benefits paid into ASB and they are taking so much money in charges of her, I've told her to open another account and claim them so she is going to try to get another account opened very soon and make a claim they must owe her a fortune and she could be doing with the money. I also have an account with them but don't use it so no charges all my charges are with TSB lol. I didn't like ASB cheques took longer to clear and when my wages got paid in sometimes I couldn't get any money out until lunch time :mad: .

I'll keep you posted on hoe she gets on, good luck to everyone else making a claim :)

the law says we`re entiteld to,for the time being that is.I see from martin lewises website that the powers that be may bring bank charges into line come april to £12 being the norm.

 

I have re-sued the Airdrie for the other £240 they owe to my wife,20th of march being the court date, will post when result comes in.Thanks all

Did anyone see the thread about claiming your charges back over 20years. It was written by a lawyer from Burness (one of the top law firms in Scotland.

 

Well i downloaded this and sent a cracker of a letter to Airdrie Savings Bank pointing this out - can't wait to see their response also told them they have 7 days to refund or going to court for £1455.00 thats just one account with the Motherwell branch.

 

I have 1 with the coatbridge branch and they owe me £600.00 and still waiting on list of charges for my 3rd account held at motherwell. Idid close my Motherwell account in 2005 and opened one in Coatbridge so I know they will close it so have set up a parachute account.

Hi All

Airdrie pay up again,even though they say that my wife had been paid

all she was due, they paid out another £240 which I claimed for,but they say she was not owed

They have no record of it,and say that 3 of the charges I claimed for don`t exist.But take the 240 go away don`t comeback stop anoying us.So I`ll go for now but want to go back 20 years now,now that they think they`ve heard the end of me.

well done mike,right thats it, iam going to claim.They sent me a letter saying their charges are justified because they are a small bank not like the other major banks and thats why they charge £30.00 -aye right!

 

Thanks for letting us know - are you really going to claim for last 20 years?

Advise and help needed!!!... I am claiming £2070 from airdrie savings bank, i have now received a reply from my second letter to them claiming all charges, they have told me until the OFT publish their findings they consider their charges to be fair and reasonable (aye right) and are unable to refund my request for bank charges, this will be reviewed once the OFT publish their findings. I am on the verge of giving up, i am so frightened of the thought of small claims court, should i go ahead? what will happen if i lose?

It might be worthwhile starting your own thread, but in the meantime I'd suggest that you might want to try using the Financial Ombudsman Service (FOS) if you're worried about going to court. Their service is free to you but they charge the bank £400 for the privilege of being investigated.

they are bluffing get the court forms and start your claim now!

Don`t claim any more than £1500 sue them from the begining

of your back charges,then sue for the other £500 odds once they

pay you out for the first lot.You will win,but be well prepared.

Sorry about that :o you can tell I'm new to this, I know I need to get the court forms from the court but I thought you could only claim £750 at a time??? Do I downloand the forms for the (FOS) from the website??

yes you can download the forms from this site in the templates library.

 

there is a way to sue for 1500 but not sure exactly were the thread is

 

you`ll just have to read through the the scottish thread and you`ll find

 

it.Not sure but I think you me be liable for the banks court fees if you had

 

to lose the case,when claiming the 1500.But spend the next couple of days

 

reading the threads.Hope this helps and good luck.
