I placed an order from gorgeousshop online (around 100 pound), and after few days since I received the dispatching email, i wondered where is my post, so i check the tracing history. I was shocked when i saw the tracing history and the proof of delivery on the Royal Mail website. Because it showed that the item has been delivered to my address at 7:52 am in the morning, and I was even shocked that the proof of delivery showed a signature which looks like the initial of my print name.

 

The point is I never sign anything in print name, simply because im Chinese and i sign in Chinese characters not English letter. And they said they delivered in 7:52am in the morning when im definitely at home.

 

There are two things are certain that my delivery address is 100% correct and I didn't get the delivery.

 

I'm truly angry that how come the Royal Mail delivery guy let people fake my signature which should be illegal i supposed.

 

So I called Royal Mail after I found out the fake signature and miss delivery, they told me anyone has the rights to sign the post for me which is normal :mad2::mad2::mad2:. And when i mentioned the fake signature, they said they can do nothing, but only do investigation if they get complain from the supplier (the website where i placed my order).

So I contacted the website, they said they will call Royal Mail and stuff, and I never heard from them again.

 

What can I do?

How did you pay for the product? If you paid by Credit Card/Visa Debit, contact your Card Provider, ask to do a Chargeback.

If you didnt get the goods then its between you and the supplier.

From what we know,as far as the supplier will be concerned the goods were delivered since there is a signed for delivery proof which says it was.

There has obviously been a failure by the Post Office,who it does not look like execised due care.

I think that you need to be putting something in writing to the supplier to see where they are up to in respect of the investigation or any claim they may have going on.

It is strange that you have heard nothing.

I think that you should make a complaint to Paypal as suggested,but that their own investigation will very likely be involving the supplier,and you will need to be showing that you have made some attempts to sort things out with them.

Therefore you do need to be contacting gorgeousshop onlineand demanding a response to see what they are doing.

gorgeousshop online have had their money.Royal Mail have had theirs,and so have Paypal-it is you that are left with no goods that you have paid for.

section 75 of the CCA doesnt apply if paypal are involved though, be very aware of that ... with ebay items, i now opt to call and pay by card over the phone where possible if its over £100, as then section 75 will apply.

 

but chargeback isnt easy... but will work (i had to argue with my CC company for a chargeback at first, I got the amount back, but had to pay £20 to auto electrician to do some tests, and show the product was "not as described" and "unfit for purpose"

i too am in the same situation as you are here...

 

and obviously, since its signed, the seller is saying their not liable...

 

amazon gave me a "goodwill giftcard" but the seller is in dispute with amazon as they are still attemping refund with him...

- i feel for the guy, as its not his fault, he posted, royal mail messed up... who looses?...

 

and royal mail are an absolute joke also...
