well as you defaulted moons ago it can never comeback on your file. but it will be Statute barred july 2022 sent Cabot another CCa request nail then in their box again and again NEVER EVER phone a DCa nor enter into any pointless letter tennis other than a CCA request where required and applicable. the only time you ever respond to a DCa is if you ever get a letter of claim or should they be so bold a court claimform. never move without informing the owner(s) of any supposed debt you last used/paid within the last say 7yrs to be safe. always ENSURE your debt owner(s) have your current and correct address should you have moved since taking the credit out with the original creditor and not informing them in WRITING you have moved.. protect against backdoor CCJ's dx

This is on behalf of my cousin who lives in Scotland. "We got a new bathroom fitted in Feb. On 28 Mar discovered tray has a fault in it which has made it extremely prone to flooding. Fitter has said he's having issues getting manufacturer to admit the fault and agree to reimburse him to fix. He's continually promising to keep me posted with progress but literal days go by with him not contacting me. Its so bad I actually need to get into shower with my 6yr old in case it floods. Is there ANYTHING I can do to speed this process up or am I at his mercy?" The installer isn't prepared to take any action until he's compensated for his time from the manufacturer. In my opinion this is between him and the manufacturer, he should still rectify the shower in the meantime. The Citizens Advice gave her this letter to send him (attached). forget the trade sale con it's NOT a trade sale and wouldn't matter even if it was..you paid via a debit card draw against a personal bank A/C which is obviously not a trader, under a business account and a trade. not sure why the RAC even mentioned trade, they must know its a total red herring and has even been on watchdog and rouge traders about this con numerous times as well as court cases!...shame on them!! you paid the dealer, look at your bank A/C... you didn't pay the owner that the dealer was selling it supposedly on behalf of. another untrue get out con.

Hi all, I applied for a loan with Bamboo nearly 12 months ago for £1200. T he loan was accepted and I received the money the day after, fortunately I was in a position were I could pay the money back within the 14 day cooling off period which I did (happy days) this week I went on my credit file which still shows the bamboo loan active with the full balance still showing outstanding 😬 surely bamboo shouldn’t of even recorded this on my credit file if I paid the full amount back within the cooling off period??

Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
I opted for mediation, and it played out very similarly to other people's experiences.
In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.
In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.
