Hi, citizen has asked me to take a look at this for you.

If the ''creditor'' name on the credit file entry has Sigma Listed as the creditor as in ''Loan from Sigma''

then they are the only company that can update the files as they are now the data controller of the account

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Just a quick update to let you know there is nothing to update!

 

Both claims have now been stayed for over a year and not a dickie bird from our friends at Sigma.

 

The longer it stays, stayed the better is my understanding.

 

They will need to apply to have the stay lifted and I think give a good reason why it has been so long.

 

You are able to apply to have the stay lifted in order to have their claim struck out. I am not quite sure of the benefits to you of doing this. I will ask others to look in and advise :)

No updates again. Looked on my credit file and the default was dated December 2008. Does this mean after this point it is statute barred, or because they started the claim before that, they can just pursue it whenever they want?

If the default was placed in in Dec. 2008 the last payment must have been I suspect sometime in late 2007, you need to know when the last transaction/written acknowledgment was made.

The credit marker should drop off this December...as with regards to the claim(s) leave it alone.

Default credit markers are defaults that show on your credit reference agency files.:-)

Not unless they discontinue or proceed with the existing claims...the claims are tied in litigation which is stayed...yes the SB clock has stopped and will only resume to tick if the claims are discontinued or struck out.

 

But the longer its left stayed the more powerful any future defence becomes and more reason to claim it should be SB as the claimants actions have prevented the limitations applying by vexatious litigation.

Well the £3k one is now no longer on my credit file, with the other one due to drop off in June. I'm now getting letters from Robinson Way for a debt that is not on my credit file - Experian or Equifax... bin bound!!!

 

 

Do they just pick an address, a figure and send out threat o grams?

Just an update. The larger claim has now dropped off my credit rating and the smaller one is due to drop off in a couple of months. This means my credit report is looking much better now. It will be three years in August since I received the summons I am feeling much better that I will not hear about it again now!
