I wanted to reclaim my Halifax bank charges under the financial hardship rule but i can't find the template.

 

I did find this and i am currently receiving benefit.but i wanted to now if it is still relevant before i updated & posted it.

No this is an old template,and since then there have been new codes of practice.

Have a look on the front page.Bankfodder I think did something on this last year.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

i can't find anything other than the link i posted before.

 

 

i'm not very good with letters and don't know what to use or if it's all relevant to me.

Can you give some background for example,what periods the charges relate to,what benefits you are getting/when they started /whether you have questioned the charges and informed them /if you have kept evidence of that etc etc...that will help to determine on the contents of a letter.

All charges have been added within the last 6 - 12months, i was receiving Incapacity Benefit when they were debited but i'm now receiving a reduced rate ESA whilst i appeal the decision to take me off IB. i haven't contacted Halifax about the charges yet but i do have online banking so i can use my statements as evidence. i have only been with Halifax for about 2 years.

 

What do you mean by period charges relate too?

You need to change the following so it applies to your particular circumstances, some of it might apply to you, but you might want to add other things. The more personalized it is the better, the more you can demonstrate the 'Hardship' by giving examples the better.

 

'• I can’t pay my debts and have recently reclaimed PPIlink3.gif from you that were mis-sold to me, these extra premiums being one of the reasons why I could not serve my debt.

• My Income has been eaten by charges some £1800 in one year alone (2008) starting within 3 months of the loan I took out from you.

• Payments regularly returned due initially to the excessive charges levied on my account these charges were disproportionate to the debt I owed and were directly responsible for my spiral into debt.

• I have been constantly over my overdraft limit and you gave me no assistance when the high charges were being levied’, these charges have contributed to making my financial hardship situation materially worse; I do though acknowledge that you occasionally waved charges and Increased my overdraft but this was too little to late.

• I had been stuck in a cycle of charges and not being able to clear them before new daily or monthly fees and returned direct debits are added on top.

• I have over the time built up various debts with family and friends trying to help me but at least the award for mis-sold PPI has gone some way to paying my debts down along with the still outstanding money owed to the credit agency but it still leaves me in debt.

 

The charges total £2636 in unplanned overdraft fees plus £780 in returned Direct Debits and I ask that you repay me the full amount.'
