Hi there I have a default against me for an overdraft of £1100 which I have now paid.

 

I never received letters of final demand etc etc

 

I tried the consumer act standard letter asking for proof that they gave me "notice" but I hit a brick wall by them telling me that the overdraft is not covered by this!

 

Is there any other way around this? is this a fobb off by the bank?

 

Please help me out?

Hi welcome to CAG,

 

There is no conumer credit agreement for an

overdraft, but usually there is a ''letter'' confirmnig

the granting of the facility which will detail the terms

of the overdraft facility, most I think state that the

facility can be withdrawn at any time.

 

You can ask for a copy of that.

I was trying to have the default removed due to not having any proper official notice, - I was going through extreme hardship at the time, lost my job, had to go back to college etc, no income at all, was claiming job seekers allowance.

 

Just seems very unfair as I was able to pay the overdraft in full 4 months after the default notice.

The only people that can remove the default for you is the bank itself.

 

It has discretionary power to do so if you can somehow find someone that cares.

 

Good luck with that.

 

Tell your MP if the bank won't help. The government needs to improve legislation to prevent further hardship following on from hardship.

You could request that it be marked " satisfied " its would reduce the negative impact.

I understand it's still impossible to get low interest credit or a mortgage with a default even if it's marked satisfied.

 

The banks know this and they should help the decent folk rather than continue to hold the country in recession.
