Right don't know what to do in this situation. Here is some background 1st.

I moved out of my dads property last year due to family problems and continuous arguments with him over a period of years and have had zero contact with him ever since. Any post that is still sent to his address is collected by a family friend and passed across to myself.

Now the problems is that I had an £200.00 overdraft on a visa debit card with Nationwide that I no longer used. The balance of this stood as £200.00 overdrawn. I forgot about this account as it was never used. Nationwide were provided with my new address for statements etc.

I received a letter from Nationwide in January telling me of the amount owed and that I must contact them to arrange a payment plan or pay this off, which I duly did.

I arranged with one of their call centre employees that as I was starting a new job I would have my wages from February onwards paid into his account to clear the overdraft and place it in credit. This was agreed and happened as planned the following month.

Midway through January I received a letter from Moorcroft to my new address stating that the debt had been passed onto them to collect which I ignored!

At the end of January my wages were paid into this account as stated and the overdraft wiped off. I then closed the account with the bank as it was no longer used!

No more letters from Moorcroft as promised... or so I thought!

Midway through March I had my monthly mail passed across from the said family friend from my Dads house. Enclosed within this was a letter from Moorcroft stating that if they did not receive payment within 14 days they would issue me with a default and they may send in the bailiffs to collect the outstanding amount. I was also informed that they had been bombarding my Dad with phone calls non stop to the point where he was frightened to answer the phone and was understandably fuming with this!

Well I contacted Nationwide regarding this expressing my concerns to which the reply was "you need to contact Moorcroft". I responded with why should I do this when the debt is paid off and the account has been closed! The unhelpful operator said there was nothing she could do and the conversation ended abruptly.

Now I have since found out that Moorcroft have indeed send around bailiffs to my Dads house repeatedly. Every time he has told them that I no longer live at the address and this is verging on harassment. This has effectively ended our already fragile/ non existent relationship with my Dad and has meant that most of my family will no longer speak to me! Now my Dads health was already in a very bad before I left home and has since went down hill with the increasing stress and pressure Moorcroft are putting onto him (he is type 2 diabetic) resulting in him fitting and being generally in a very bad shape!

Now my question to you is what should my next move be? They have made his life a living hell, damaged his health further and have practically destroyed the fragile relationship I have with him and the rest of my family. Also this debt DOES NOT EXIST!

What do you all advise. What can I claim from them if anything and how can I get this mess stopped permanently? Your help is really appreciated people!

Thanks J

Hi have you checked your credit reference files yet?#

If not please do so asap.

In the letters from Moorcroft does it say the are collecting

on behalf of Nationwide or that they now own it?

Get this information to me and I'll write a letter for you.

Also have you got statements showing that the OD was cleared.?

Hello Jamie,

First thing I'd do would be to check your credit file and just check if there is a CCJ on it, if not then you will find the Bailiffs aren't Bailiffs and can be told to foxtrot oscar or the police will be called as they are trespassing.

It is common for some DCA's ( debt collection agencies ) to post letters to an old address regardless if you have updated them with a new one.

It sounds like you also need to send some letters off, firstly to Moorcrap telling them not to call you ( the telephone harassment letter ) and another telling them they are not welcome to call round your dads house. They have to make a prior appointment, you never agreed to it.

I would then send a SAR ( subject access request ) will cost you a tenner to Nationwide as asking them to disclose anything they have for you on file, so you should get your account information, which as you said should show a £0 balance and the account closed with nothing outstanding.

You could also go into a Natoionwide branch and see if they can give you a closing statement, send this to Moorcroft and tell them to swivel.

Going back to your credit file, you might also want to check it incase there are defaults, or they have trashed it too.

They are the steps I would take, others on here might do it somewhat differently, so have a look at the range and make a decision based on that, but I highly suggest you get the harassment letter off asap, it can be found in the library link.

I suspect That the so called bailiffs that have visited

are Moorcrofts doorstep collectors who are commission

paid oiks they have no authority are dfinitely NOT bailiffs

and can do nothing.

Uses Experian & Equifax Call Credit are often not uptodate.

My credit file is showing the account was defaulted in September and that the account was satisfied and closed on the 15.02.2012

In the letters from Moorcroft does it say the are collecting

The letters are stating the following: "we have been instructed by Nationwide" "our clients"

Get this information to me and I'll write a letter for you.

I have my closing statement for the account

Make a formal complaint to the above, they will auto pass this onto the OFT&TS.

Lodge a formal complaint with the bank also, you need to exhaust their complaints procedure, this is wholly their responsibility, DO NOT make this complaint over the phone, you have no evidence of the content of your calls (unless you can record them?)

It is NW who are at fault here, the dimwit you spoke with reference this previously was probably the cleaner, if you get nowhere fast with the complaint to the bank, then let us know.

Inform your local MP also, and have them made aware of the circumstances surrounding this, and the effect the banks failure and the actions of their chosen third party to harass you, is having on your Father.

BBC Watchdog would be another angel to use, and the media/press.

I despise this country's financial institution and how corrupt they have all become.....

Get making those complaints, keep a diary of events and keep EVERYTHING in writing.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
