Hi

 

I am asking this on behalf of a friend.

 

My friend sent a CCA Request off to American Express, as she is having a few problems with them at the moment, she received a letter back a few days later saying:

 

Please find enclosed a copy of the online application and Terms and Conditions relevant at the time the account was opened and closed. These documents form the executed agreement between you and American Express.

 

Attached to the letter was credit card agreement regulated by the consumer credit act 1974 (printed on the bottom was executed agreement) this credit agreement was not signed by my friend.

 

Am I right in thinking that although it doesn't have her signature on it is still legal as it states it is an executed agreement?

To satisfy CCA1974 sect.77/778 it need not have#a signature,

an online app will not of course be signed but is an enforceable

agreement.
