    • Update! I have now opened the mail from Barclaycard. I am assuming that their letters were prompted by my confirmation to them of my change of address, which I had advised them of twice. They are treating my change of address notification as a "General Data Protection Regulation Right of Access Request"  and state that I have made a "Right of Access Request. They are asking me to provide valid indentity documents! I have made no such request and am minded to ignore their request for extra information? I should add that their letters were sent to my correct current address!
    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!
    • Yes, a few months ago. They wrote back saying there was no CCA and the debt was unenforcable. I then started gtting bombarded with threatening emails from their 'litigations team' which have been sent to spam. I've now recieved the letter before claim with the PAP form enclosed, but still no CCA or even a letter from them to say the debt is deemed enforcable. Thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Faulty Mattress from Bensons for beds

We purchased a Kingssize divan bed 16 months ago when it was delivered the mattress and base were both covered in red ink, Bensons agreed to replace the whole bed but insisted on ordering one instead of supplying from stock this took almost 3 months to be delivered now a year later the mattress is colapsing along the whole legnth of the bed on both sides, we turn the mattress regularly as instructed but it makes no differece also one of the drawers keeps on falling off its runners. Bensons sent out what is supposed to be an independent inspector from Eco master however Bensons put a lot of work through Eco master so im not sure how independant they can be if they want the work from Bensons. The Inspector looked at the mattress and sai it was faulty he asked if I sit on the edge of the bed which I dont I pointed out that I have a stoll to sit on to do my hair and makeup he agreed that because the fault is along the whole legnth it could not be from sitting on the bed, he then lied on the bed and said how uncomfortable it is and how it almost tips you off the egde when you are lying on it he said he would not repair the drawer as there is no point due to the fact that the mattress is faulty and the whole bed needs replacing. I then waited and after 10 days Bensons had not contacted me so I called them to find the Independant Inspector has told Bensons the complete opposite of what he told me, he has said that the Mattress problem is due to sitting on the edge of the bed and the drawers can be repaired and he has ordered the parts. As a result of this report Bensons are refusning to do anything abou the Mattress and 2 weeks later I have still not been given a date to repair the drawer.

I now have a 12 month old bed which is not fit for the purpose intended.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

No the Inspector did not fill out the report on the premises he just scribbled a few notes down after complaining that Bensons are saying different to what the Inspector told me Bensons have since sent me a copy of the report which I have copied below

 

Local and furniture good. Wear and tear; Customer has a king size posture care pocket 1000 Mattress is sitting on a

 

horizontal split solid divan with 4 drawers which is supporting well. Customer has had bed for 13 months and is

 

complaining that both sides of the mattress are collapsing and giving no support and causing customer to roll to

 

outer edge. Mattress is clean and unsoiled and customer vacuums monthly. Customer turns and rotates monthly.

 

Manufacturing; also the customer was complaining regarding the bottom right hand facing drawer which was not

 

running smoothly. Report; Compression test showed very firm in middle but lacking support at edges. Lay test

 

showed firm and supportive but there was some rolling to both edges. Level test showed no signs of dipping.2 users

 

13 stone and 14 stone Customer advised they do no sit on the edge but the edge it appears that perching on the edge

 

would be consistent with this. The right hand facing side is worse than the left hand facing side. On inspection of the

 

drawer the runners were slightly buckled. There were no items in the drawers on attendance and no signs of

 

overloading. The customer advised the drawer had been like this since delivery. Parts to be ordered from

 

manufacturer 1 set of drawer runners 2nd visit repair time 30 minutes

It would be very interesting to find out if that is exactly what was in the engineers report, or if it has been edited slightly. Especially as you say that he agreed that due to the dip being along the whole length of the mattress, that it wasn't consistent with sitting on the edge.

 

I would stronly advise you to contact Trading Standards, and maybe BBC Watchdog as well. You may be advised by TS to get your own independent inspection done.

Thanks for your help, I have contacted Trading standards today I am now waiting for them to get back to me and I have also contacted Watchdog, I will let you know once I have replies from both.

It is often a good idea to send a copy of the letter to Bensons, making it quite clear that you have sent copies to Trading Standards and Watchdog.

ok thanks I will do that, Bensons have replied saying that as far as they are concerned there is nothing wrong with the bed the dipping is due to us sitting on the bed and they say you should not sit on a bed so they will not do anything about it

They will always try that one, until they realise that you are being serious. At which point they often back down.

i have got a visit from ecomaster on 9th july for bed that has collapsed on one side from k&co (shop direct ltd)

and dont have much faith in ecomaster after reading your comments
