Hello

 

My husband and I parked in one of the parent/child car parks at Waitrose and went shopping with our baby. When we came back we had a parking fine notice of £20 on the windscreen. As we are using a travel system they could argue that we did not have a car seat in the car.

 

My question is, does one need a permit to park there (ie Tesco is doing those permits but nobody ever uses them) and if no, should we pay the fine or just ignore it?

its a speculative invoice

 

the only ones you need to pay are the ones

that say and ONLY THESE THREE WORDS

 

PENALTY CHARGE NOTICE

 

and as with any road markings in private car parks

 

they are purely graffitti with no statute in law

Hi danisahne, I'm sure someone with more knowledge will be along shortly.

 

You say a parking fine notice, is it off a council or a private parking company?

 

If its off a private parking company its not a fine, just a glorified invoice which you can ignore, then ignore all the begging letters that you get.

 

Private parking company's can't fine you, they don't have the legal authority.

 

If it is a private company, and it says the word fine, that's naughty of them and they could be in a bit of trouble.

All markings on private land, be it yellow lines and disabled or P&C bays have no legal basis.But out of courtesy you should't park in disabled bays if you are not disabled.

They can argue whatever the hell they like, but for your part you should leave them to argue that amongst themselves and you should quietly get on with your life :)

Just to double-check, the notice says PARKING charge notice rather than penalty charge notice, so we should not pay? They also stated "parent and child" as reason, not explaining any details like ie "you parked there without a child", so we don't uunderstand why we got fined in the first place.

The reason they call it a "parking charge notice" is that it has the same initials as a council penalty charge notice. A cynic would say that it's chosen that way so as to fool people into thinking that it's an official document, instead of an invoice you don't have to pay. Also, it's not a "fine".Only official organizations such as the courts, the police or the courts can fine people. Private citizens, such as this company cannot fine anyone.

 

From now on please stop taking this company seriously, they are not worth the effort.

Unlike disabled bays which they have to provide, parent and child bays are simply a courtesy now seeing you parked having a child with you then that courtesy was not abused! However whatever the reason they gave you an invitation to pay them some wonga, simply ignore it, they have no authority to penalise you!
