    • Just out of curiosity aesmith - are you a lawyer?
    • I spoke to a pro-bono entity this afternoon.  They advise I must initiate a claim in the court v the receiver if I want to then file an application for an order for sale.  I must have a claim/ proceedings to be able to force a sale. The judge in the current proceedings  has told me that I cannot force the lender to sell and the lender cannot interfere either.   If the receiver isn't acting correctly and isn't selling - this means I must make a claim against the receiver I could initiate a claim. Or much quicker  - the other entity - with a charge already - could use that to make an application for an order for sale.
    • Thanks Dave It's not too far away, about 8 or 9 miles, so I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices. The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.
    • This other entity doesn't know what's going on.  To be clear I had huge equity.  No-one would ever expect a lender to erode all my equity.  The question is - if anyone knows the legal answer - on the basis they have a charging order - could they make an application for an order for sale?

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I have received an eviction notice for 10 May 2012, and have managed to get a hearing on N244 on Friday 04 May 2012 at 1030. I could really do with some assistance for my defence.

My circumstances have changed slightly and I have offered the company (GE Money) the monthly payment and £200 a month towards the arrears and they have not even responded to my letter.

Also, my daughter is right in the middle of her GCSEs and this would likley knock her off track and ruin her future.

Any assistance would be gratefully received.

Is this the first eviction notice? The reason I ask is normally the judge will suspend the eviction at first notice to allow you an opportunity to repay the arrears, (however this is not guaranteed and shouldn't be relied upon its just in my experience this happens) Have you called or spoken to Shelter? if not I would call them straight away, they will make sure you have representation. If it is the first hearing normally your rep and GE rep will probably get an agreement before court appearance and then it goes before judge who will grant the eviction but suspend it whilst you keep to arrangement. So I would ring Shelter 0808 800 4444 (its free from most phones including mobiles). The advice I have given is from my experience dealing with different companies/HA's. I dont know how aggressive GE Money so get some advice from Shelter

I know my rights Mr DCA I'm with the CAG......hello hello where you gone Mr DCA8)

They have to have a good case to get a repo especially if you can show that you can afford to pay something off the arrears.

If this is your first appearance and you have written as you say with an offer, it is very likely that they wont even show up knowing that the judge will accept your offer.

Don't offer £200 if it is tight and you are likely to default on it, offer half that much and take an income and expenses sheet with you.

Many thanks for your response, yes this is a first eviction notice, I will call Shelter today.

I have also offered them the money direct from source out of my wages to see if this makes any difference.

Hi there, how much are the arrears?

What did you put in Q.10 of the N244 you submitted to court (I'm assuming you kept a copy for yourself?)

Also, did you keep a copy of the letter you sent to them? and was it sent recorded delivery?

The arrears are quite large (15,000) although there is still 8 years left to pay. I did keep a copy of all letters I have sent, and I also faxed it across to them.

In the Q10, I put about the offer I have made, and that they have not responded, that our circumstances have changed which will enable us to pay more each month, about the offer to have it taken from source and my daughters exams.

Did you affix a budget sheet so the judge can see how you will afford the payments? also, did you quote the Norgan case law?

OK, the Cheltenham & Gloucester v Norgan case law allows the judge to consider payment of the arrears over the remaining lifetime of the mortgage. Lenders usually want arrears cleared much quicker than that so you really need to include it. I can draft a statement for you to take to the hearing with you if you'd like. Also, did you affix copies of the letter to the N244 ?

who is the lender?

Ell-enn

I did affix a copy of the letter to the N244 when I submitted it.

The lenders are GE Money and yes a draft letter would be amazing as I don't know where to start.

I feel as if a weight has been taken off me just contacting you. Many thanks to all of you for your assistance.

Here goes, are there any late payment charges included in the £15k arrears ? - there are about £4000 payment charges

what was the reason for the arrears? - originally due to an incorrectly set up direct debit, but then we had some money problems that added to it,

how many children do you have living at home? - we have two children living at home, although one in 18 next month.

is the mortgage in joint names? - yes the mortgage is in the name of both myself and my husband.

I don't know if it makes any difference, but this is a second mortgage, they both have 8 years left and together come to @£120,000. The house itself at the moment is worth @£165,000 (this is based on the price of a smaller property in our street that sold this month).

Do you have any proof of the incorrectly set up DD - was it their fault?

Also the judge will probably want to know what the "money problems" were.

  • 2 weeks later...

This went absolutely fine. The judge rejected the eviction as GE Money's possession order was incorrect and stated that I had no arrears, so therefore there was no reason to evict us.We have now come to an agreement that we are both happy with.
