    • Thank you for your reply, DX! I was not under the impression that paying it off would remove it from my file. My file is already trashed so it would make very little difference to any credit score. I am not certain if I can claim compensation for a damaged credit score though. Or for them reporting incorrect information for over 10 years? The original debt has been reported since 2013 as an EE debt even though they had sold it in 2014. It appears to be a breach of the Data Protection Act 1998 Section 13 and this all should have come to a head when I paid the £69 in September 2022, or so I thought. The £69 was in addition to the original outstanding balance and not sent to a DCA. Even if I had paid the full balance demanded by the DCA back in 2014 then the £69 would still have been outstanding with EE. If it turns out I have no claim then so be it. Sometimes there's not always a claim if there's blame. The CRA's will not give any reason for not removing it. They simply say it is not their information and refer me to EE. More to the point EE had my updated details since 2022 yet failed to contact me. I have been present on the electoral roll since 2012 so was traceable and I think EE have been negligent in reporting an account as in payment arrangement when in fact it had been sold to a DCA. In my mind what should have happened was the account should have been defaulted before it was closed and sold to the DCA who would then have made a new entry on my credit file with the correct details. However, a further £69 of charges were applied AFTER it was sent to the DCA and it was left open on EE systems. The account was then being reported twice. Once with EE as open with a payment arrangement for the £69 balance which has continued since 2013 and once with the DCA who reported it as defaulted in 2014 and it subsequently dropped off and was written off by the DCA, LOWELL in 2021. I am quite happy for EE to place a closed account on my credit file, marked as satisfied. However, it is clear to me that them reporting an open account with payment arrangement when the balance is £0 and the original debt has been written off is incorrect? Am I wrong?

I Know! .... someone here with a chance to sue Highview for breach of GDPR with a very good chance of winning, I was excited reading it especially after all the work put in by site members and thinking he could hammer them for £££'s and then, the OP disappeared half way through. Although you never know the reason so all I can say is I hope the OP is alive and well regardless. I'd relish the chance to do them for that if they breached my GDPR.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys, can anyone advise me please

I have a mortgage account that was originally with GMac, then transferred to Webb resolutions and now managed by Lapithus Servicing LLP.

We have a had a long battle trying to keep our home with 8 eviction hearings. Each time we have either made payment arrangements or cleared the arrears.

We are currently just under 3 months in arrears and they have again applied for a possesion order of our home but this time they have added £10k of charges including direct debit fee's, court costs and account management fee's.

What I am asking is can they claim these costs or are they unreasonable?

And does anyone know anything about this Lapithus Servicing LLP

Many Thanks, I thought i could reclaim the charges. They are charging me £50 a month to pay by debit card!

 

I cant see that this reflects their costs in anyway, I would certainly be making attempts to claim those fees back.

HI Guys, yes el-een they have added the charges balance to my arrears and are going for possesion off the back of this. I will read that article and keep you all posted. May need some more help guys but many thanks already!!

Hi Bayman, Good luck, I had the same battle with Webb after been transfered from GMAC, I had 6 court appearances and eventually the judge threw their case out as they were waisting court time. I asked the judge about the unneccessary costs as I felt they were very unfair and he awarded in my favour, it's worth asking at your next hearing

Thanks for that, we have had absolute murders with Webb. From the start they have only been interested in repossesing the property failing to understand its our family home, times have been tough work wise but we have been trying. How did it end up being thrown out if you dont mind me asking?, message me if you prefer

Hi Bayman,

I know what your going through,

they are not a company to do deals with as they just want your property

and to apply as many charges to the account so it looks good for them in court!!!..

 

.I had my property on the market and I was going through the process of mortgage shared equity with the local council (which takes time)

 

The judge could see I was doing everything possible and he adjoured 3 hearings because he could see it was a process that could take at least 3 months.

 

Webb are liars true & true,

 

please get everything in writting because WEBB deny any verbal telephone conversations in court,

they never cancel court cases so always turn up and never trust them.

 

I had an offer on the table from mortgage to shared equity a week before we were due in court.

(I got my council to deal direct with WEBB to keep them in the loop!)

 

and they refused to cancel the court case and in court WEBB refused to accept the deal that we were made by the council

as they said they would only accept a different deal!!

 

I had a letter from WEBB that I put in front of the judge and he could see that WEBB were moving the goalposts with more un-neccessary added expenses to us,

 

so he threw their case out of court and told them to go away and wait at least 3 months to give us time to sort out a new deal with the council.

 

He also awarded us the costs for that court hearing.

 

My council were so shocked at the actions of WEBB after dealing with WEBB by phone/letter/emails for 14 weeks.

 

They could see we didnt stand a chance of every making any deals to keep our home.

 

It started with £4000 arrears and 12 months later over £20,000 with legal fee's and what ever fee's they could add,

I feel so gutted because there was £150K equity in the propery but they were not interested,

and we couldnt get a loan because our credit rating wasnt looking rosy,

but I so know what you are going through. chin up and dont let them get you down

Hi guys

Went to court today re:eviction. got a suspended order but the judge wouldnt consider or enter into conversation about the claim for the fee's balance. Best I get started in claiming theese fee's then!!, thanks for all the help so far guys

i need help please or advice ! to start off im reading the all familar tale about webb resolutions destroying lives. as per they have done to myself.

 

after our mortgage with mortgages plc was sold off to webb resolutions, arrear free but did have some in the past..

 

i then lost my own retail business due to the credit crench from 2009 until 2012 it has been a nightmare.

 

after having arrears of £1800 along with a suspended order the judge awarded possession unless i made within 72 hours - a long with it being a firday at 2 pm i had little or no chance

 

webb resolutions refused offers of £104 in full to clear the mortgage and the rest of the amount owed is in legal fees and charges was 22k ,

 

im bewildered by this amount and since they will not comunicate with me im feeling very lost indeed..

. they went to court with 3 solicitors against my one.

. we lost because webbs representatives not would allow us to get a word in edge ways

and everytime we started to explain something they had a ready made legality to fight back with.. no common snese nor morals.

 

i then found my home for sale at £10k under the asking price which i felt was ok considering.

i have then found out today they have accpeted an offer of £120k.

. this is not in my best interests as the mortgage still had some equirty in it given the right selling price.

 

i also feel and im sure as well that webb resolutions have acted incorrectly

but i really need help and a good legal firm to do this.

funds i dont have right now.

 

i would also like to try and get my home back. it has new kitchen , bathroom etc and its my world

- my life feels its been ripped out of me and im falling apart with a little hope i can do something to stop the sale urgently and fight this via the courts.

 

also web resoultions offered a help to sell scheme working with you in order to sell,

this was not offered to me even though i did ask for this option they wanted to reposess me regardless.

 

they are not regulated either and its a huge worry for me fight a firm like this who show such aggression in dealing with human beings.

again i stress my arrears were £1800, hardly £10k -- they have so far desttoyed my life and im now homeless litrally with no roof over my head.

 

they have caused me huge anxiety and worry and but i unless i get some action again them my world is going to fall apart and so i am.

i genuinely need help as i believe i should be able to get my home back or prevent the sale for now.

 

i really need some honest adivce so private message please.

Hi everyone, as expected Webb/Lapithus have ignored my final letter so I am now preparing for court action. Can anyone help me with the intrest part of the claim?. My charges exceed £7500 so I need to get it spot on. Also any pointers in the correct forms etc would be helpful

Hiya I have been fighting against webb since 2009, I complained to the FSA about Webb Not being registered to administrate a mortgage and since then have been dealing with lapithus, I would love to see webb brought to justice about what they do to people and there lives, I have had 10 suspended possession orders and 15 court appearances. \You have to keep on fighting these people, I am now again going to go back to the FOS and the FSA, with complaints for charges, my charges are 8,000 over the 3yrs and this time in court they asked to add them onto the arrears but the judge said no. This time a solicitor turned up and they sent a barrister from London who sat in court behind the solicitor and said sod all and that will cost me at least £600, they try to bump the costs up and then add them onto the arrears, so that it covers the equity in your property and you have less and less to fight with. I have learnt over the past few years to email everything to them, because you then have proof of what you are saying, and this helped me massivly this time in court as Webb/Lapithus just lie about everything, they told the judge they hadnt seen may wage slips, income and expenditure and other things, which I had attached to an email and produced in court which totally annoyed the judge that they were lying. I owe £15000 in arrears but my mortgage is over 17yrs left so I have got plenty of time to pay my arrears off and this is what I was awarded, but I now have been told I carnt apply again to the court to stop any eviction which Im not happy with because as you all will know Webb/Lapithus dont need an excuse to apply for a warrent, so I am now going to the FSA because I believe this is a breech of my rights to protect my property, I didnt argue at the time as I didnt want to rock the outcome of the order. I have to make sure now that I pay what they want within the month, as before I had paid my mortgage over the three months but a bit more one month than the other, this apparently is what Webb want because when they go into court they say that you missed one month but never say that you paid 2 the next month, only proof to the judge that I had paid the total amount needed over the 3 months plus money off the arrears went for me. I now need to consentrate on my fees and my complaints against Webb/Lapithus, they need to realize what heartache they cause people. Any help would be gratefull
