      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been helping my mum with a claim for mis sold ppi from a loan that she had with lombard direct

 

we sent off a covering letter and the ombudsmans claim form and she received a reply back off lombard dated the 13th Feb 2012

saying that her claim was being investigated(no time limit was mentioned) we received this letter on the 16th February 2012

and now at present i believe that the time limit is 8 weeks for investigation into a ppi complaint so we are now at 10 weeks today and she has not yet had a reply.

 

Is she best giving them a ring to see what is going on followed up with a letter do they have to adhere to the 8 weeks guidelines.

 

Advice welcomed please

Hi , Personally i would call them , and call them ....it worked for me in my successful claim with HBOS , i think these companies are well bogged down with the sheer volume of complaints

 

Im sure there is a letter to send and others will be along to advise you on that

Nothing wrong with calling them and making a pest of yourself.

 

You can also write to them telling them that they are beyond the 8 weeks and therefoer if they do not repay you within, say, 14 days the matter will be taken to the fos

ok just an update

 

phoned up lombard for my mum they told use that an offer letter had been sent out in early April

however mum has received nothing

 

they were going to send out another one but there is about a month delay in getting them out

 

my mum was just amazed that they had upheld her claim ( she has no faith ) lol

 

yesterday the offer letter dated 3rd April appeared at my mums

 

they have offered her around £2750 and it is £15.00 more than my calculations

 

she is well happy but they have deducted tax 20%

 

yet she does not pay tax as she is not working and her pension does not start till jan 2013 how can she claim this back.

This is good news then....well done and congratulations on your win. :whoo:

 

As far as the tax goes, she will need to contact HMRC and arrange for a refund direct from them if she is not a taxpayer.

Will do ims21 and thanks to CAG another sucess hopefully i can get her to make a donation as i have got another 2 claims to do for her so will start seperate threads for these.

Well happy for her because she left it to late with the bank charges and lost out.

Hi lombard have not been that bad to deal with although my mum is still waiting for her cheque which when we rang last week she was told it had been sent 2nd class on that monday so as soon as it is here i will update this thread.

and has been paid in

 

just need to get her tax back now as RBS have taken 20% off her at source which i believe i can do by using a R85 form.

 

This has come at the right time for her as she does not get he pension till early next year and things were getting a bit tight.

hopefully mum will make a donation to the site could someone update the thread title for me.
