Just because we were doing the John Grisham version of Blue's Story, doesn't mean that you can promulgate even more rumours!!:cool:

 

Last we all heard was that the Baliffs were due in and nobody at the Bank had even heard of any problems......curiouser and curiouser!!:shock:

I'm really really sorry to have left you all in the lurch. I was so busy before I left on holiday I simply didnt have time to post the latest:oops:

 

When I got back I found a couple of notes from the bailiff asking for confirmation that RBS had paid the full amount of £1346.32 which was the amount owing at 11/7. Of course they haven't, so I phoned the bailiff this morning and told her. She can only go after the amount on the warrant and can't take account of the interest owing and of course any amount I am going to charge them for phone calls and sheer aggravation! I still haven't heard a word from Cobblers (love that, BigCol).

 

There's another twist to this convoluted tale :grin: - can you believe it!

Because RBS had paid £1291 odd into my Mastercard account on 4th August, I didn't bother to pay the minimum asked for by 24th August. Silly me, I came back to find a £12 late payment fee on there and when I phoned them this morning, I was told that a credit didn't count towards a minimum payment :lol:

I said in an incredulous tone of voice, believe, "so it was the wrong kind of money?" and they said well, yes.:lol:

 

I'm slightly hysterical now so if anyone's got any bright ideas, now's the time to produce them. I'm thinking of writing to the RBS litigation department ( I think there's an address on a Sticky) to get the extra interest (it's not very much but it is mine) and some compensation as above! Is that a good idea? I'm still thinking about the whole press, TV etc. route but not sure I want to do that.

what absolute jack asses!....yeah, maybe should write a letter to press / media from a whole bunch of us?.... with the recent thing in press about the OFT now switching from focus on credit cards to now looking at these F**king ridiculous bank charges, reckon theyd be interested!!!!

Another thing occurs to me re the phone call to RBS this morning - the person I spoke to said that although I have now set up the next payment I would have to be prepared to get more letters and phone calls until that payment hits my account because - and this is the interesting bit - they are system-generated ;-) No kidding! We didn't know that, did we? :wink:

They are system generated!?!?!?!?!? My god!?!?!? Does anyone else know!?!?!? I'd better sue my bank,....erm hold on!!!!!!!!!! ;):D

In the post this morning, I got a Notification of Request for Certificate of Satisfaction :D - hey I could do with some of that! RBS have applied to the court for this certificate and also for the entry in the Rgister of CCJs to be removed or marked to show that the debt including any interest is satified. Well, of course, it's not so I have to reply in writing within one month, which I will do of course and I'm still going to write to the litigation department. I see from BigCol's thread that Cobblers have a website and a full-time Quality Manager :eek: Might just drop him a line as well ;)

This is the letter I am intending to send to Kay Stanbridge at the RBS Litigation department. Is it OK or does anyone have any suggestions?

 

I am writing to you to express my deep dissatisfaction with the way this claim and subsequent warrant have been handled by RBS and Cobbetts and also to try and bring the matter to a satisfactory conclusion.

 

At no time have I ever had any communication from Cobbetts regarding the progress of my claim and I have been unable to persuade anyone from Cobbetts to speak to me on the telephone because I do not have a Cobbetts reference – their mistake not mine. I only found out that my claim had been partially settled by phoning Simon Lamb in Southampton. He contacted Litigation and told me that £1291.32 had been paid into my RBS mastercard account on 4th August. I was not very happy about this for two reasons: one, if asked I would have preferred a cheque or a BACS payment to my current account with XXX and two, it was not the correct amount. They have not paid the warrant fee and there is an outstanding amount of interest due. As far as I am aware, the bailiff is still pursuing this. I have of course not been informed one way or the other.

 

I did not pay the minimum amount requested on my RBS mastercard as I thought that it had been covered by the substantial amount paid into it on 4th August. I was therefore shocked to discover I had been charged a £12 Late Payment Fee. On phoning I was informed that amounts credited were not counted towards a minimum payment – information I find totally unbelievable!

 

I would like you to investigate whether or not the outstanding amount has in fact been paid to me. I also require you to cancel the £12 Late Payment Fee. Furthermore, I have been put to considerable inconvenience and expense, including numerous long-distance phone calls, by the lack of information and Cobbetts’ incompetence. I calculate that an ‘ex gratia’ payment of £200 would be adequate recompense. Please do not pay it to my Mastercard.

Sorry again for the gap in communication - I'm getting a bit fed up now!!!!!

I had absolutely no response from the Litigation dept. so sent another letter plus a copy of the first one on 30th Sept. No prizes for guessing what happened next - you got it - NOTHING :o

In between times, I have had a couple of notes and phone calls from the bailiff in Southampton - RBS think they've paid in full (ie including the warrant fee) but oh dear, they're not quite sure. Do I know if they've paid up?:eek: No they bleep bleep haven't:rolleyes: And all the time the phone calls keep mounting up. At this rate the £200 I have claimed for phone calls and hassle etc. won't be nearly enough. I know I've said this several times over the past few months, but now I really don't know what to do next. If anybody's got any bright ideas I'd love to hear them :cool:

It's finally OVER!!!

 

I can't quite believe it myself but I've had a cheque for £55 (the warrant fee) from Cobblers. This brings this sad, sorry saga to a close at last :D

 

If ever a thread was misnamed, this one was :rolleyes: Talk about tempting fate :lol:
