Me too :D However the nice person at MCOL told me that the bailiff writes to them first of all  and gives them about 7 days to reply before going round   Extraordinary, isn't it? This has been going on since 3rd April.

I've just phoned the bailiffs and I've been told they have to give the bank 10 days from issue of the warrant before making a visit. They've got the warrant as issued on 13th July so it'll be 23rd July. So if anyone lives near Southampton (I'm in Kent) and fancies an outing, don't forget the camera, in fact don't forget the camera crew :D - and I'll be adding on all these phonecalls too! So far I've phoned Edinburgh, Manchester, Northampton and Southampton twice.

Sorry, sorry BigCol :D

As the bailiffs told me to give it 10 days from the warrant being issued, I reckoned I should call them again this morning, which I have just done. 'My' bailiff is out of the office till Thurs. and there's nothing on the screen to say she has taken any action on the matter. The chap I spoke to told me they give them 8 days  before going in and he thinks she'll deal with it on Thurs. Whatever, the bank would have got a letter about the warrant being issued and 8-10 days after that the bailiffs go in. I simply can't understand why RBS are ignoring this matter - I do hope I'm not a test case. What would I do with a load of desks  or could I insist on laptops?

I think I'm going to have to PM a mod (which one?) and see if they've got any suggestions. I will keep you posted!

yours seems to have got lost in the system, the rest of us seem to be following a very similar pattern! whats annoying is they'll only apply for a set aside when they do finally acknowledge you!!!!!!!!!!!!! I bet your sick of waiting!

You're not wrong :D

I hope they won't dare apply for a set-aside after all this time but if they do, I believe both parties have to agree and I would be very tempted to say no! I've already demonstrated bucketloads of cooperation and tolerance etc. Oh well, I'll just have to keep on keeping on

Blue,

well gosh and darn it:eek: , more waiting! I'm not sure how the baliffs work, don't know whether they take some gear and then sell it and you get your dough or they give you the goods? My RBS has got a nice coffee machine that I've had my eye on, I wonder.......nah, screw 'em - we wants cash!!:p

Looking forwards to Thursday for you....

You know, I do worry about you fellas holding your breath like that. It can't be good for you :D

I haven't posted because there's no news and in this case that's definitely not good news:rolleyes: I phoned the bailiffs again on Thurs. only to be told that it would 'most likely' be dealt with that week but I have still heard nothing and there was nothing in the mail. I just can't understand why I'm getting no response from the bank at all. I'm now going to PM a mod and I will let you all know as soon as I know anything!

I PM'd AlanfromDerby and he said that it could take as much as 28 :shock: days for the bailiffs to go through the process of what they have to do. I still don't understand why the bank is not responding at all. I feel like the invisible woman - there's no icon for that - unless Bookworm's got one!!

Fooled you huh!:D

I can't believe I was so naive. But my claim against First Direct went so smoothly I thought RBS would be the same

SolidChris - this thread has turned out to be like an excerpt from a training manual on claiming your bank charges  - hope it helps you and Me.x. All that's missing now is the money

Good Luck though and I'll keep watching and hopefully let you all know how my case in going soon!

I wouldn't worry too much - I think I have slipped through the net because Cobbetts forgot to put a reference on the acknowledgement of service  . If you get as far as that on any of your claims, just remember to check that there is a Cobbetts ref. :D Good luck anyway ;)

Hello Stacy, no and no

I'm pretty fed up as you can imagine! I calculate that the 28 days AlanfromDerby mentioned are up tomorrow but I just can't believe the bank has not responded at all - oops, yes I can

Haven't a clue what to do next :confused:

Hi

I'm at a similar stage to you BUT according to the court when I phoned on Tuesday to see if the bailiffs had been actioned, I was told yes and they had signed it off as the RBS had told the bailliffs they had paid me in full. Nobody tried checking with me which I find a bit (very!) strange. I now have to resend in the bailiffs, it won't cost any more money only time, which I really don't have.

Hope you're having more luck!!

I take it they haven't paid you in full?

I've been phoning the bailiffs but not getting any info from anyone. I think I'll try the court again, in the light of what you've said. I wonder if this is a new ploy from RBS - drag it out long enough and we'll get bored - they think

Thanks so much for that suggestion sbroad! I've just phoned Southampton court and discovered that the bailiffs have been in touch and RBS phoned the court this morning to ask what the claim was about :D :D Can you believe it - after all this time they still don't know what I'm claiming. Southampton suggested they phone Northampton. I'm still laughing...
