Well I wrote to Credit Security Ltd on 29th July 2006 asking for a copy of the original signed agreement with two debts with Barclays (which I have been paying through them - last payment made 31st July 2006)

 

They acknowledged the letter on 10th September 2006 saying they have requested a copy of the agreements and that I should continue to make the payments. So far I have ignored them although I have had two "reminders" and today they have phoned me asking why I haven't paid. I spoke to two people saying that until I get the copy of the agreements I consider the debt in dispute and I will not pay.

 

They just kept rambling on about my agreement with them doesn't charge any interest and that I should continue to pay.

 

I believe now they have comitted an offence by not supplying the copy agreement, I said that if they contact me further without the agreements I will consider it harrassment.

 

Any thoughts?

Under S40 of the Administation of Justice Act(1970) and under S1 of the Protection from Harrassment Act(1997) they are committing a criminal offence.This is one of the route's im going down.I suggest you make a log of all the telephone calls you receive date's times etc as this will be your evidence.Plus if or when court action is instigated you can ask for disclosure of there phone records under CPR they must disclose them.To be honest I think their on a hiding to nothing. Oh and don't pay them another penny as their in default.
