Can someone help me?

 

I am trying to claim a large sum of me back from a client.

 

I am unsure as to what court is best to raise my claim in.

 

I do not want to use MCOL I hope there is another court I can use.

Yes, MCOL is designed to be the easiest and most effective method.

 

As for physical courts, it's really up to you; you can issue in your local County Court for convenience but beware that if the defendant is an individual and the claim is defended then it will be transferred to his local court.

 

How much are you claiming and is it a fairly straightforward contractual claim? I assume the High Court will not be necessary.

The default procedure in my terms and conditions which is writen out in full is vrrdy straightforwar.

If you do not want to use MCOL then you can submit forms at your local County Court BUT the hearing will take place at your clients nearest County Court under normal circumstances. The amount in dispute dictates the type of claim that will be made.

 

Without any more info we are stuck on how to advise further.

 

 

 

The OP will have to send his claim to the Salford Business Centre to issue but should state which Court he wants the case to be heard in.

This is a cash loan transfered by bank transfer.

This will obviously be over the small claims limit, so you're leaving yourself open to costs being awarded against you if you don't succeed with this. I agree that you should seek legal advice on this, even if it's a free initial session to get a view if your claim is likely to succeed.

I have already had a claim that is now going through baliffs.

 

But It has not been challanged yet in a court of law.
