Howdy.

After 6 weeks of waiting, I finally received my deposit cheque today.

I have a couple of concerns about some of the charges the LL has applied.

Firstly, it's in Scotland, so there is no Protection Scheme.

The deposit was £695, of which I received £353 back. This doesn't sound like a big deal, but we spent a lot of money before we left replacing cushions, cabinets, doors and decorating. We lived there for about 2 years, never had any arrears or anything like that.

 

The charges applied are :

Carpet Cleaning : £79

Cleaning : £88

Door lock and Washing Machine repair : £60

Alarm Repair : £65

Admin Fees : £50

 

Cleaning I dispute as we had friends over and we scrubbed every inch of the flat before we left. Carpet Cleaning I also don't understand as any dirt on the carpets (only in the bedrooms) would be down to, I feel, fair wear and tear ... they weren't obviously, or overly stained.

 

Door lock and Washing Machine repair, im not sure what that relates to, but does the Washing Machine count as general fixture and fittings that is the LL's responsibility to maintain? (if it's a fault or something). There was a draining problem with the WM, but we reported that to the LL months ago.

 

Alarm Repair ... I don't know what this relates to either, we never used the alarm as we have a dog and he'd set it off all the time.

Admin Fees ... I looked in the lease for this and the only mention I see is "

 

"The Landlord may deduct from the Deposit any unpaid rent or other monies for any loss or expenses incurred or suffered by the Landlord or any sums expended by the Landlord arising out of any of the foregoing matters including reasonable legal and other professional fees."

 

Do you think I should contend these charges?, I have sent an email today but I don't know how far to take it. I know the LL isn't registered, which could be a problem for him, but does that affect any claims I might make against him?

addenum ... In the email today, I asked for an explanation of the charges, and asked for copies of the receipts for the work.

I know the new tenant moved in 3 days after we left, 'because I had to show him around the flat when he was viewing and he called me to say "thanks" on the day he moved in.

Hi yes I would contest this the washing machine if it

forms part of the tenancy agreement should be maintained

anually tested anf if necessary repaired by the landlord.

Cleaniing you had already done it.

Alarm same as above.
