      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry if in wrong place - mods please move.

 

I have a catalogue debt, which I have been paying off at £10 a month.

 

I went to make my online payment the other evening same amount, (I am sure I filled in the £10)

 

I get record today that I have paid off the account all £300...

 

I have no proof I did this I only get automated reply thanking me for my payment, no amount is mentioned.

 

At the moment I am on ESA (for depression) so cannot afford that amount all in one go.

 

I cannot even swear I did not do it, although I am certain I filled out the amount to pay, and DID NOT click on 'pay balance'.

 

As you can imagine this has left me in a mess financially as well as doing nothing for my depression.

 

I probably already know the answer as they are not going to give it me back are they.

Is there anything I can do.

can you not recall the payment by phoning your banks help line?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

My bank say it has gone from my account and offered me NO more help.

Can they do what you suggest - it was the 5th of April I made the payment and it came out on the 8th.

 

I just do not know what to do.

are you SURE they have not just snafu'ed by using your info

 

i take you have been silly and have been paying it on their website portal

after being pressured into a debt thats prob heavily inflated by loads of unlawful £12 PENALTY fees

that can all be reclaimed?

 

this is why you must never use these fleecers online webportals

 

dont think you stand a chance

Yes I am always silly goes cap in hand when your suffer from depression.:sad:

 

I am paying reliable collections as I fell behind with payments, when I fell ill.

I pay £10 a month through the 50+ website have done for years.

 

I just would like to know if there is anything I can do, I know I have been silly, so telling me again - does not help - you could not make me feel any worse than I already do.

me thinks you've been spoofed for quite a While here.

 

have you got all the statements

 

they prob owe you more than you owed them.

I have only had 1 letter from them - when I was late with a payment so I guess that would have cost me!

 

If my bank opens a dispute, (which they now say they can and will) is it up to to RC if they pay the money back or not.

I don't expect they are legally bound to are they? No such luck.

50+ is the catalogue (I think they are all part of JD Williams)

 

My account is online, so every month I logged on and made the payment.

I refused to set up a DD as they could have taken what they wanted (they still might have).

 

When you log onto your account you get 2 choices either the minimum payment or to pay the balance.

I typed in £10 so there was NO way I clicked on pay balance - but proof there is non, as the automated receipt only tells you 'thank you for your payment'. SO cannot prove anything.

I do not have that money to settle the account, my bank balance is now over drawn and all I have coming in is the £90 from ESA and that is not due for another 10 days.
