Very, Littlewoods and Kays refusing my minimum repayments.

Hi

 

I have a few accounts with some catalogues. Very, Littlewoods and K&co.

 

After struggling with money recently, we are managing to get by paying our priority debts on time however i still have these catalogues hasseling me for minimum payments which i cannot afford. I have wrote to every one of them explainin my situation and offering an amount per month which i can afford is the same amount for each account.

 

I have received the following reply;

 

Thank you for your e mail regarding a possible payment arrangement.

Unfortunately we are unable to accept your offer as it does not meet our minimum payment criteria.

Please contact us on 0844 822 4090 within the next 7 days to discuss the options available to you. If we do not hear from you, we will assume you no longer require our assistance in this matter and we would expect normal payments to resume.

Please note that failure to bring your account up to date will lead to administration charges being applied to your account and could affect your ability to obtain future credit. Your account may ultimately be passed to external debt collection agencies.

 

I feel this is really unfair, as I have offered a payment which I can afford and at least I am actually making some contribution towards the debt. If i go back to paying there minimum payment demands I will be struggling with my priority payments such as mortgage and energy bills, food etc.

 

I just dont know where to go from here, its really stressing me out making me ill and causing sleepless nights.

Hello,

These are not priority debts,so you are right what you say.

It is important that you keep things in writing,and have no obligations to call them to discuss repayments if you have already done so in writing.

Do you have statements from these catalogues ?

How much of the outstanding balances are charges for late payment/admin charges etc ?

You should be claiming these back.

I will move your thread to the catalogue forum.

Can you give some more details about each one ?

1.How old the accounts are

2.What is owing

3.any other info.

Catalogues are not priority debts.

If you have offered an afordable amount and are paying it regulary then keep this arrangement up regardless of what they say.

 

There threats are all hot air, they will go no where near a court if you are making payments, no matter how small.

 

NEVER EVER speak to any of them on the phone. If they ring refuse to answer their security question and tell them in writing only.

 

Their tool is your fear. There is nothing to fear, if they don't like what you offer, tough, just pay it.

Also get all the late payment over limit charges credited back to the account and ask them to freeze any unincurred interest or there is no point paying token payments as the balance will just rise each month.

 

If they won't play ball, two can play at that game.

YOU control your finances, not them.

Fear not from the likes of these creditors, they just bully and intimidate to get ill-affordable payments

Thank you that has really put my mind at ease. I know i am doing the right thing using my money to pay mortgage priority bills and food as I have small children to think of too. Do you have any suggestions to what i can write back to them in regards to the above letters i have received from them?

That you have acted reasonably in offering a repayment that is as much as you can afford,yet they are demanding a minimum payment which is well beyond your means.

That you believe these actions are breaching Office of Fair Trading guidelines.

That you expect a reply in writing by 7 days together with a copy of their complaints procedure which is your entitlement.

That they duly accept your proposals for repayment or in the alternative you will be making a complaint to Trading Standards and the fos.

You expect all communications to be in writing.

 

 

I also suggest that you begin to add up what you have been charged in admin fees late payments etc for all these accounts and report back here with the dates/figures.

 

 

 

Keep a copy of your letter and send recorded delivery to

 

Shop Direct First Floor Skyways House, Speke Road, Speke, Liverpool, Merseyside, L70 1AB

 

 

Since this is the same company-you can list the different Catalogue brands/account numbers at the top of your complaints letter.

Thank you for all your help I have received the following back, after tellin them that I will be paying x amount each month..

 

I am sorry we have been unable to come to a payment arrangement with you.

 

Unfortunately we are unable to accept your offer as it does not meet our minimum payment criteria for your balance.

 

I would advise you to seek advice from a third party company, such as the CCCS or CAB as they may be able to help with your payments.

 

We are unable to freeze your account until a payment arrangement is in place so please contact one of the above companies so they can assist you with your finances

you write back and TELL them as a goodwill gesture in times of financial need

they are only going to get £XX for XX mts [tell dont ask]

 

make the payments to them by your internet banking site - they cannot refuse it that way.

 

as a reciprocal goodwill gesture, to secure the level of repayment you've promised

you REQUIRE them to refrain from levelling any unlawful PENALTY charges & to freeze the account interest.

 

failure to respond with a like goodwill gesture

will leave you with NO alternate than to drop them to £1 PCM for the rest of your life!

as your payments will be in-effective in redusing the balance.

 

END of!!

Ok guys today I have received "pre escalation notices" telling me since I have failed to bring my account up to date this is my last chance to talk to them before my accounts will be passed to nationwide debt recovery limited.

 

I have just come home from work to this and feel sick to the stomach I just don't have this kind of money to pay these people :-(

Yes good point.

It can just be a merry go round and far better to put a hard copy in the post to their R/O by recorded delivery and demanding a copy of their complaints procedure.

IF THEY THEN FAIL TO RESPOND OR ELSE DO NOT FOLLOW CODES OF PRACTICE,IT THEN LEAVES THE WAY OPEN FOR YOU TO REPORT THEM AND HAVE A PAPERTRAIL.

I think it is a threat o gram as I rang them this morning to confirm the address to send my repayment proposal to and they gave me shop directs address not the address that's stated on there letter ! They told me to send the letter to sandringhan house with a signature ?

Nope it's the address that comes on the letters from shop direct themselves, strange - as now its been passed to NDR I just presumed I'd send something to them instead?

 

No idea why they need my signature but they are not

Getting it. My 7 days is up today to contact NDR to pay the balance and I haven't actually done anything yet will get a letter in the post today to Sandringham

House see what happens next
