      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

So I recently sent a PPI request to the above company and am now a little confused.

 

Basically the insurance is called Credit Protection Insurance - is this different?

 

They've refused that it was mis-sold as we told them that we already had similar insurance and that in their summery it is stated that they DO NOT recommend that product.

 

However - they managed to sell it to me. If I already had insurance of a similar type then surely they should not have sold it to me?

There's a Demands & Needs Questionnaire with questions answered either Yes, No or Did not wish to discuss and completed on the computer. Then on the second page it says 'Protection against Death, Illness, Accident, Sickness and/or redundancy (Credit Protection) - I do not recommend this product'.

 

It's fair enough as we weren't too sure what we had on this policy so it was really a letter to see if we did indeed have anything on the policy.

No - we would not have insisted on it. The fact that we said that we had insurance when we didn't was because we were trying to avoid the extra costs and put them off from selling us extras.

 

It was in 2005 so it's hard to remember but we definitely would not have insisted however it appears to be sold fair and square. It's not so much a complaint thread more an information gathering thread :)

It seems to me that this is a classic case of mis selling. There is loads of info in the stickies at the top of this thread as to your next move. I'm a bit rusty on this so will have a scout round and come back to you later.

Sorry for the confusion. Basically I came here straight after reading the letter for some advice. The reply was quite convincing therefore I assumed that I had no claim on the PPI. So what I was trying to say is that I was just wondering why I was not so that I know for future reference.

 

Robins and Day is a car dealership - the finance was with Banque Financial who I sent it to and they forwarded it on to Robins and and Day as according to them it was their problem.

 

What information would you need from the agreement?

Also to add - on the information they sent there are a few question relating to any existing insurance that I had. These are 'Do you have any existing insurance that will pay for your monthly vehicle finance payments, if you fall ill, have an accident or are made redundant?', 'Do you have any existing life cover?' and 'Are you satisfied that it will cover you for the extra financial liability you are taking on?'

 

The answer to all these is YES. We did this to try and put him off trying to sell anything extra to us but he still went on to sell us a product that as far as they were concerned we did not need as the 3 questions above pretty much cover what the product had to offer us.

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

I have the 'HIRE PURCHASE AGREEMENT'. Is that the same thing - if so I will have to get another copy as this in the state it's been photocopied is unreadable?

Ok so if you didn't want this PPI and didn't agree to it but it was slapped on regardless you should get in a claim to the lender.

 

You said that the broker did not recommend the product and yet it appears on your agreement?

 

If that's the case then it was put on there without your knowledge or agreement.

 

Is that how it was?
