      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

So I had a welcome loan which i took out in 2004 (approx) In 2006 I increased the loan amount, and i finished paying loan off March 2011.

 

A letter arrived in Decemeber from FSCS saying I had been mi sold PPI and to please complete the application form.

 

So when I took the loan out I specifically said no to PPI. At the time I worked for an insurance company so knew all about PPI and all the ins and outs, so I was very confident I didn't want it.

 

So FSCS wrote 2 weeks ago and said my claim had been denied as 'because i worked in an industry selling PPI I should have known better' (along those lines anyway).

 

I wrote a letter of appeal on Monday and said they weren't getting the point of my complaint. - I specifically said no to PPI so they must have added it on without my knowledge or consent!!

 

This morning I recieved a reply saying they still will not uphold my claim, however the letter gives some interesting information I didn't know before. The letter says

 

'As no PPI was sold with the initial loan, only when it was re-written, we feel that you were fully aware you had purchased the insurance cover and were happy to accept the additional cost'

 

This is interesting, so about a year into having the loan i increased the amount of the loan. I went into the office again to do the paperwork. Again, I specifically said no to the PPI. So it looks at though the wideboy I was dealing with added it anyway.

 

I didn't question the amount I was paying as I had increased the loan by double and with their whopping interest rates the new amount didn't make me worried.

 

I really want to appeal this now with the Ombudsman because I'm furious I was cheated out of this money. They are using the fact that I worked in insurance against me though, anyone know why this is?

 

So does anyone have any tips on how I can make my next letter to the ombudsman get my points accross correctly?? I think the amount owed is around £2.5k, and as you may see from my other posts i'm currently in a very bad way financially so this money could really help me. It also gets my goat that my financial situation might not have been so bad the last few years if I wasn't unnecessarily paying out for exces insurance I didn't need!!

 

Sorry for the long post - this is why i need help writing the letter!

its undoubtedly a case of the office staff doing it afterwards

 

this is very well known about with/at welcome

the staff got a heafty commission to their wages for doing it

 

write back.

 

and ask for a copy of both agreements and the statement of needs 'i think' doc

 

that should throw up what happened [search for POSTGGJ posts in the welcome finance forum]

 

they sre wriggling because they know as a rollover loan

this could cost them £1000's

Should I sar them before i take any further measures? I did call welcome a couple of years ago as i wanted a copy of my paperwork and the branch i took the loan out had been shut down, and the call centre said they didn't have any paperwork. What happens if they don''t have it?

let see sar welcome thay must have something as they are able to relate how you brought the loans

they are just trying to put you off.
