Hi

 

Wonder if anyone can offer some advice as my partners getting really upset.

 

We received a parking ticket (operated by DaVinci)for parking in Ninewells Hospital in Dundee as we put a wrong parking ticket on the widescreen. It was £30 or something. I asked for the circumstances to be taken into consideration and wrote within 48 hours of receiving. We heard nothing and a month later had a letter from Roxburghe saying they had been instructed to recover £70 form us.

 

The background is we had premature twins (25 weeks) As they were so small and sick they were transferred to the specialist unit in Ninewells (70 miles away) We have 2 other boys so travelled up and down daily, which continued to happen until mid December. The neonatal unit gave us parking tickets were you scratch of the date to help out. Our youngest twin died on 1 October after 11 days. His brother was more of a concern miraculously continued to battle through, however was on more than one occasion not given a great deal of hope. Sometimes we had to leave the ward when he required intervention or procedures to be carried out. One of those days 17 October we went into Dundee to get away and came back later when we got a call that we could come in and see him. By accident and in our rush, we've put up the pass we scratched the day before and we've therefore had a parking ticket issued.

 

Absolutely it's our fault however, I would have thought in the circumstances (and we did have a valid ticket although not displayed) this could have been waived/cancelled.

 

Is it worth continuing to fight this, I honestly thought they would have seen our letter and even tried to verify it with the ward and waive the fee in the circumstances but alas no. My partner gets upset talking about it. I've asked Roxburghe to only phone my mobile however they phone the landline and she gets upset as it's still so very raw.

 

Its just not needed at this time but none of us really have the emotional energy for fighting.

Hello there.

 

I'm really sorry you're having to contend with this as well as everything else you've been through.

 

I hope the forum guys will be along soon. I have a feeling they will tell you to ignore, but I would prefer them to say it in case I've missed something. Hopefully they will also tell you how to lessen the grief with Roxburghe.

im sorry for your loss, it never ceases to amaze me how cruel some people can be in this country.

i and a lot of others could relate to not having the emotional energy to fight your corner on this.

i would send a letter recorded delivery explaining everything that happened and the circumstances surrounding it, and again ask them to verify it with the hospital, be polite and ask them to waive it.

As a last resort you could involve your local paper and shame them into it.

Don't bother to write at all.

 

Don't engage with them in any fashion. You have already seen the extent of their consideration and sympathy. Remember, they are not the police or council and therfore have no right o "fine" you or issue a "penalty" charge.

 

Completely ignore any more of the junk mail they send you, short of replying to any OFICIAL court papers they may send (1 in a million chance of that).

I appreciate all the responses and your kind words. I'm not sure what we'll do but I feel less stressed about it, just need to calm down my partner.

Roxburghe = **** of the earth. But their powers are absolutely ZERO. All they do is to write idiotic letters. The only time they have EVER been to a courtroom is when they were sued, successfully, for harassment.

 

You have enough on your plate with the personal tragedy of what has happened. Do not even think about this, because all you have to do to get rid of these indescribable morons is just to ignore them totally from here on. They WILL go away. Everything they tell you is lies.

 

Keep the letters in case you decide to sue them for harassment.

I have joined this site just to reply to this thread.

I operate a PPC and post regularly on MSE.

 

Please can i firstly say sorry for your loss and the distress being caused by someone in the same business as myself. The way they are conducting themselves in this case is extremely bad taste.

Whilst i have no direct control over anothers accounts with Roxburghe i do have regular dealings with them if you would furnish one of the more trusted members on here like give_Them_fa just your ticket number will be fine i have no interest in prying or anything else on this site i just cannot believe how "i cant think of a word here im actually getting angry" they are being with this.

 

I will contact them at roxburghe and hopefully i will be able to have some persuasion on this case and get it closed for you.

 

Failing that or if you do not wish to give me them details rest assured NOTHING will come of this in any way shape or form. They will cll you nd also send you letters but after a few months (not ideal i know) they will give up.

 

Please let your partner see this and do not under any circumstances pay this amount to roxburghe or Vinci

Dear Lord what you and your wife have gone through and now this. However it proves one thing their appeals process is a complete sham! Whoever decided to pursue this invoice should be publicly flogged!

 

As for PPC-Guy and his offer although he is from the dark side he does seem a reasonable person having had many a forum discussion with him on MSE and he may be able to get this sorted.

 

I know you can just ignore them but it must be upsetting getting these phone calls at this time.

my ONLY purpose on this forum is to help this poor couple get this issue resolved. MY son was born with distal phalanx duplication (basically had 2 thumb tips) and the stress was immense without people irritating me. I am so so sorry for wht the OP and their OH is going through. As mentioned if someone pm's me (preferably on MSE) with the ticket number or a reference number or anything i will do my utter best ot get this issue resolved now rather than the poor couple having to put up with roxburghe caling them and upsetting them more.

Fair play - we've all made mistakes. I used to work for a certain company who get a (well-deserved IMHO) slating on other parts of the forum until I realised that the pay really didn't cover the huge dent it was putting in my self-esteem, so I buggered off to do something more productive.

Does it make me a bad person? Well I thought that if good people do nothing then a company that doesn't care will never change and I could at least give them a hope in hells chance of getting through to someone who is competent and cares, but I just ended up learning the true meaning of the phrase 'p***ing in the wind' and cut my losses.

Just to try and help you out about them telephoning you, I had all sorts of problems with a DCA and someone advised me to do the following, when they next call, enter that number into your phone book and head it as " DO NOT ANSWER1 " so that when they ring you know who it is and just ignore it.

 

They may well try several phone numbers so do the same to them numbers too (the next one do as DO NOT ANSWER 2 " and so on, apparently what happens is that they have several different No's to try and fool people and their computer system is set to ring your number, but they alternate to different numbers so they think they are fooling you, when they get an answer the system puts you to an operator who gives you all the grief..

 

I am so sorry what has happened to you and I can sympathise with you as I had trouble with a Hospital Car Parking company, my son was seriously ill and we had to get him to the hospital, I parked in a Disabled bay by the maternity unit which is next to Peadiatric special care. It was 1130PM and I displayed my disabled badge clearly visible on the dashboard. After 3 hours they gave me a ticket (we are still in the special care unit) then an hour later they clamped me..... boy doesn't it pay to work for the police force (only a civvy) they removed the clamp and ticket but then sent me a ticket through the post, so I just ignored it and they went right to the stage of sending out court forms but they FAILED to turn up in court and the judge awarded against them. Many other people were clamped the same and paid like mugs, but I made sure a few did what I did and the firm went bust after they started getting summons's for clamping Dr's and nurses cars in their own car park......

I tried the Car Parking company but as the court papers got served they went out of business all of a sudden. The court did award me £250 compensation when they failed to turn up first time and they did pay it ...... The MD of the company left the country and the mags court did issue a warrant for his arrest on some embezelment charges or something....

Sounds pretty standard for a clamping company then. I am very surprised you got your money.

 

But people need to be aware that they can sue the principal for the actions of its agents. Landowners would be a lot less keen to let these cowboys on their premises if they generated claims for damages against them...

Vinci are pretty ruthless and will pursue you to the end of the earth to get the money. You need to get a letter from the doctors who treated your children as evidence and send it to them. You should also write a letter to Gerry Marr (Chief Executive) as well and send him a copy of the fine and your consultants letter. You should also get Shona Robison (MSP) involved as she is very good at sorting things out and I think Ninewells is in her constituency - she is definitely there a lot on ministerial duties. Vinci can and do waive fines but you should get as much help from influential people as you can if you are finding it too emotionally difficult to deal with.

Pretty ruthless? The only way they can do anything is to take it to court. Will they want to take this one to court? With M.P. interest, and the press ready to put it in a prominent place, my feeling is that this is one they could do without trying to enforce. They could be pointing a shotgun squarely at their foot if they did.

 

Anyway, I doubt they can be that serious if they go down the route of using rubbish like Roxburghe to try doing the job for them.

They asked for CCTV footage of someone giving their ticket to someone else to use for evidence as tickets are not transferable. I work at the hospital concerned and there are always complaints in the local papers regarding their prusuit of people - staff, visitors, contractors and patients who have parked "incorrectly" as well as complaints received by the hospital themselves but because the car parks are privately run the Hospital cannot waive them. Vinci have always said that if you can provide evidence they would stop any further action but you are supposed to do this the day they give you a ticket to stop it going to a debt collector.

It is not a debt!

If they go to court, first they have to win their case, they have to prove their made up charge is not a penalty. If they do manage to prove this ( not very likely).

If you then refuse to pay what the court has ordered , then you may get a CCJ, and only then!

And as we all know the chances of that happening are so remote.

And how could CCTV footage prove to vinci who they were? Do they know everyone in the country?

Please read around this and other forums and you will soon get the idea of how PPC work.

Dont be taken in by Vinci!

I am sure that this was well-intentioned, but please DO NOT make posts in which you give an opinion masquerading as fact. There is nothing to waive, these are not fines or statutory penalty charges, they are just a demand for payment of an alleged debt (one that probably doesn't exist!) and have no statutory basis in law. They can only be enforced by Court proceedings and the claimant must prove that there is a contractual debt.

 

The law on this is not simple, but some aspects are quite clear. And, in case anyone has missed it, this incident happened in Dundee and therefore any proceedings to recover it are governed by Scots Law, not English Law, and the parking company would be a "Pursuer" in a Sheriff Court action. Scotland seems to have a lot more sense in these matters - for example, wheel-clamping by such companies of a car in a car park and demanding payment before release is a criminal offence in Scotland, and it is in that context that these parasites would have to convince the Sheriff that there is indeed any debt payable by the OP... bacon will fly before that happens!

 

I assisted my daughter's boyfriend in County Court proceedings to force a parking company to hand over his car after it was towed from a private car park (he was visiting my daughter at her flat). After getting default judgement for £700 against them (the car was worth £500) the company asked for the judgement to be set aside and their solicitor Tom Walsh, of Walsh & Co, Truro, attempted to justify the seizure on the grounds of distress damage feasant, an old provision that was intended to address the issue of damage caused by straying animals.

 

The result? The claimant was awarded over £5,700 as the District Judge also awarded £10/day for loss of use, and they had had the car for over a year! The lesson is that you must not allow yourself to be bullied by these people, and giving in to their unlawful demands is a huge mistake.
