Hi everyone,

 

Since the begining of this month (March 2012) my son has received 3 different requests for payments of debts.

 

One is from FPC(since had one from their "friends" Bryan Carter) This is in the hands of Lee as its a Vodafone issue. A thread under Vodafone and DCAs s already on here.

 

One is from Hamptons Legal on behalf of Red and is for an o2 issue (never had a letter from Red to my address)

 

The other one is from Advantis Credit regarding British Gas.

 

I can not understand why in such a short time so many letters have arrived (has a database been sold on or something)

Also I dont know where to start in the process.

I have read some threads and my mind is so messed up I would appriciate some guidence of any sorts

Has he made apps for credit/ used a comparison web site/ bought

a new phone??

Any of these can trigger the system.

I f he has no knowledge of these debts

send each DCA the ''prove it' letter from

the CAG library.

Hi Brigadier2JCS

Thank you for your reply, to my own knowledge he has an idea of the british gas one as this was from a flat he lived at but it was pay by card system

and he admits to stop making payments as the owner of the flat owend the shop below and had TWO meters in my sons hall that were pay as you go meters

that my son aso put money into (he thought it was the electric) and one of them was supplying the shop.

 

My son left the flat and has had nothing regarding british gas.

 

Where would I locate the "prove it" letter is there a link here? as I think this would be a way to actually see what its about cause I believe its the owner of the flats bill and not my sons

if BG wanted the money

they'ed have asked

 

i'd be very very sceptical about ANY demands from a dca on BG debts.

 

whatever you do

 

never ever talk on the phone to a DCA

 

they have NO legal powers at all.

Today got a letter from the o2 situation through Hamptons Legal again, this time they are using the same "ifs" and "maybe's" and this time they are offering my son a 50% discount if payment is made to deal with this situation "amicably" to prevent court action, they also go on o say or he can pay £40 a month till balance paid.

 

Why would they offer a 50% discount??

Discounts are offered usually when they have

nothing to backup the claim or the debt is very

old.

I am sure I read up on here that it was a indication that they were chancing their arm big time and prob didnt even have the original documents.

 

Its knowing when is the right time to ak them to prove it I guess

Got a notice of intent from Advantis today, a nice new format and pink letter basically saying what the last letter said, with all the Failure to take the above advice MAY result in the following

"a dect collector may be instructed etc etc"

OR

"Advantis Credit MAY instruct solicitors to commence legal action in a County Court. This MAY result in a CCJ against you"

 

As I said basically the same thing the last letter sent on the 15th March , so My thought is WHY havent they done it as it was threaterned to me in last lettter.

ANYONE want to answer why and what they reckon my next steps should be with this latest letter ???

File it under IGNORE, if they were going to do anything then they would have dones so by now, your on their list of people to harrass and intimidate.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Advantis are chasing a british gas bill that I mentioned in an earlier post.

I havent sent them anything yet as it was filed under "ignore"

Should I be sending them a CCA request now?

How old is this bill from BG?

 

Hi Bazooka Boo,

These letters are to my address but with my sons name, I had mentioned earlier that it was to do with a flat he lived in, where he found out the landlord was feeding his shop (below flat) at the same time. There were two coinslot meters in my sons hallway that he put £1 coins into also (he thought it was for electric) My son use to pay gas by card over counter.

This was only about 18 months ago

But as this is for the BG meter, then when did your son last pay for the gas? How much roughly and was he aware that there was still an amount outstanding on the account?

Is the gas also used downstairs in the LL's shop?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I am not sure when he last paid, but we do know that the LL was using my sons gas and electric as we switched EVERYTHING off and the meters were still spinning, (this was when the shopm was being refurbished)

I believe that the LL had pulled a fast one and pointed BG in my sons direction.

I know my son questioned the meters with the LL and BG but apparently BG had ment to have called out with the LL.

All just seems a little dodgy and Im reckoning its actually the LL bill and not my sons.

I will try to get a clearer picture from my son but unfortunately it was not a very good time for him as he and his girlfriend of then had just lost thier baby to still birth and is the reason they left that flat.

I am very sorry to hear of such tragic news, this is in no way a priority for him.

 

There are a number of things you may be able to do to help him with this, firstly this is in dispute not only with BG but with the LL as well.

 

I reckon your correct and the LL has pointed BG in your sons direction, did your son have a tenancy agreement? Does he still have a copy of it?

 

IMO my first port of call would be to inform this DCA(?) that this is disputed, not only with BG but with the previous LL also.

Also a formal complaint could be made to BG about the circumstances of this account.

 

I am also wondering whether the tenant services authority (TSA) should be involved?

 

It's no great shakes, keep everything in writing, and keep a diary of events. Log everything.
