Hi, i'm new to this site and appreciate this is just going to be a repeated question as I see these two companies are rather popular on here.

Basically I have the same problem, my 300 pound loan is just over 2 weeks late and is now over 1000 pound.

I have asked for a repayment plan but been refused.

I have followed advise on here and emailed the financial ombudsman who replied with a complaint form which I returned yesterday.

My problem is I recieved a text today from NDR saying in 2 days bailiffs will be at my door. I just dont know what I should do next?

I'm a working single mother to a 3 year old and there is no way I can pay that amount in a lump sum.

Any help very gratefully recieved.

I am intrigued to know what the FOS say......I think you should email NDR and tell them that your dispute is with the FOS. Ask them for a breakdown / interest rate calculation on how they arrive at the figure.....

I've had extensive dealings with this shower as well.

 

However, there is more chance of Lord Lucan chapping your door than there is of NDR. you will soon receive threatening letters/emails/texts from a company called Marshall Hoares Bailiffs. Again, don't worry. They aren't going to turn up at your door. They are in fact all linked to the same company, CIM Technologies, who have had previous warning(s) from the OFT. You will quite often be left telephone messages by the same person, claiming to be from NDR one day, and MHB the next.

 

Companies like this are the lowest of the low. They prey on those who don't know their rights and will be pressured/scared into paying them not only the original loan, but fantasy land interest figures and charges.

 

Write to them, insisting that all contact be in writing only (i'm sure there is a telephone call harassment letter amongst the templates), and insist that you will only pay the original loan plus one months interest, at whatever monthly repayment you can afford, and stick to your guns. also inform them that ALL correspondence received from them will be copied to the OFT/Trading Standards.

 

They are basically online loan-sharks, with no teeth.

 

You will probably receive the following types of threat:

 

  • "Door Agents"
  • Attachment of Earnings
  • "Bailiff Action" - Pretty bloody unlikely without a successful court action!
  • Court Action - Unlikely to happen, as they know fine their charges will be queried
  • Having goods up to 9 times the value of the debt seized - Just LOL. Utter rubbish
  • Various other badly worded nonsense (including anti-fraud stuff - again, total cack)

None of these things are likely to happen. I think i've read of isolated cases where their agents have turned up at people's doors, in which case you simply tell them that as you have not agreed an appointment and do not want them on your property, you are quite entitled to tell them to **** off. If they refuse to leave or make you feel threatened in ANY way, call the Police.

 

However, it's VERY VERY unlikely you'll get a visit.

 

In short, stick to your guns and copy EVERY piece of correspondence to the OFT/Trading standards.

 

Do not worry about these lowlifes.

 

One of the site admins will probably be able to give you more comprehensive information, but the above is my experience of them.

I agree with what everyone has said here. Do not panic. Bailiffs are as likely to turn up as me reaching the peak of Mount Everest on foot in 10 seconds. From what you are saying is that you cannot pay. The best thing left to do is let the account default and be sent over to a Debt Collection Agency. From there you can follow instructions the people above are saying. If they do not refer the account to a DCA or class it as default'ed and increasing the interest substantially because you cannot afford the full amount straight away then they are being totally unreasonable and should definitely be reported. I believe no one here has heard of a payday loan court case where the creditors have won and so most payday lenders like NDR/Toothfairy are extremely unlikely to take any case to court.

 

I am in the same situation but with another company who do not want me to pay back in installments but in one great super fat lump sum. It has been 5 months and they still have yet to come to agreement with me on how I am paying it back. I have never even spoken to or contacted them since they first declined a repayment plan and then promptly put my head in the sand for the whole 5 months. After having a few letters I have heard nothing from them since december. I am planning to complain to the OFT and FOS once I get the next letter from them.

Other than that just take it as it comes. Do not fret.
