Righto, sorry about that.. this is a Bryan Carter trick to split the claim.. I just assumed.

 

You should be ok to send the CPR letter on behalf of your daughter as it does not require a signature. So if you just type/ print her name that should be ok. :)

this is a Bryan Carter trick to split the claim.. I just assumed.

 

As soon as I saw 'Part of monies owed' I automatically thought of BC. Just goes to show, the old adage, "to assume makes an ass out of U and ME." is still prevalent :-)

Hi, sorry I haven't updated for ages. I haven't heard anything back regarding this after submitting my daughter's defence back. I had written to Capquest to ask if they could wait until my daughter was able to come home and sort all of this out and they waited until after the deadline before sending me a letter back to say yes. I had already got an email from her which I had attached with the defence documents.

 

Does anyone know what this means? I called the courts this morning and they just said that Capquest had received the paperwork but had not taken any action.

Need to send DPA to Barclaycard and Barclays Bank

It simply means the claim is stayed....until either party make application to proceed.

I have argued in the defence though that my daughter did not owe the money claimed and that they should remove the defaults from her file as they should never have been there. I said that I could provide this proof to the courts at any time that they requested it. I still want her credit file cleared but if they aren't going to take this any further how can I do this. Any help appreciated.

In that case you would have to make application using the N244 to lift the stay to proceed to trial to resolve the matter (and defaults)Assuming you think your defence would be successful.

My daughter just emailed to say that she received a letter from Capquest. This is the gist of it in her words...

 

"(In a nutshell) It says that neither them or the court will look into the case

and action will not move forward at this time,

 

They are currently in the process of obtaining documents from the original creditor

to answer the matters in defence without further use of the courts.

 

It may take a while but will keep you updated"

 

Would it be worth still applying to lift the stay?

 

My daughter has applied for a job and has been given an offer on condition of her credit check.

 

She doesn't think she'll get it after they have done the checks because of the defaults.

 

She is worried now that this will spoil her chances of getting into the line of work that she wants.

 

Any advice please.
