    • Well tbh that’s good news and something she can find out for herself.  She has no intention if peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now- post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!  Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.  Somehow rekeyed as normal when I was called with the results.  A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

    • I think you have the supremacy of contract as it allows you to park in designated areas. I would argue that there being parking enforcement there clearly means its to be used as parking and as such you can use it under your lease. Only need to worry if they ever follow through with a letter of claim and a claimform though

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Message sent to Kwik Fit Customer Services 14/03/2012

 

My car is currently in the Kitts Green Kwik Fit in Birmingham.

 

It went in with a broken front nearside coil spring.

 

So far your mechanics have managed to make my car totally unroadworthy by breaking the drive shaft.

 

I am guessing that your guys despite your adverts stating that you do Ford repairs aren't actually competent working on Fords.

 

I have had a sheepish phone call today stating that you (kwik fit) were having difficulties changing the coil spring and that you were worried that you were going to break the ball joints on my vehicle should you then proceed with the coil spring replacements.

 

I was then advised that they didn't want to do both sides, which is normally the recommended procedure when dealing with suspension on a vehicle.

 

I had my doubts when visiting you today as the mechanic stated that there was only two mechanics working that day.

 

I would be intrigued to know how my drive shaft became damaged beyond repair. I suspect it to be down to negligence.

 

Surely it is a matter of compressing the coil, removing the top and bottom bolts and removing the strut and spring, how on earth did the drive shaft get damaged?

 

My original phone quote on Friday was £110 and today it has gone up to £250, the increase I suspect is down to me having to replace parts that your staff informed me they are going to damage in order to replace my coil springs.

According to Kwik Fits website this is a "Suspension Specialist" depot which is why I took it there in the first place..

Today I rang Kwik Fit customer services

 

The end result they put me i'm touch with the depot manager

 

He told me the £110 I was originally quoted was for a single spring.. If you google a spring for a ford Mondeo it should be £45 approx each

 

He also said the £250 was for a single side!

 

Do they think I am stupid?

After contacting head office today everything has been rectified at the cost of 2 Coil Springs at £73 each

 

The total cost after the damage to my drive shaft would have been £492

 

I have to take the car back in a couple of weeks to get the tracking done (for free) once the new springs get to their normal rest condition

 

My dad was the manager at Kwik Fit when you opened up in Roseville Road in Leeds during the "bad" days of Kwik Fit, I helped out in the workshop on your opening weekend

 

I then became an Electro-Mechanical Engineer and I have a good idea mechanically what is needed on a vehicle and what isn't

 

This experience with Kwik fit has been my first bad experience and I must admit it has dented my confidence in using Kwik Fit,

 

What could have been done better?

 

  • Keep the story the same,
     
  • if there are difficulties tell me don't wait until everything has gone pear shaped,
     
  • keep the customer informed
     
  • Be honest with the time and cost quotes, to me an over estimate followed by a lower bill is better than a cheap quote that then triples

 

My car is my workhorse and to be without it for two working days is totally unacceptable, as a self-employed contractor I cannot afford to be off the road

 

I must say thanks to the Kwik Fit Manager Joe Singh, who ensured that my car was ready tonight, Joe has probably had a day from hell sorting out my motor as the mechanic who dealt with it wasn't back in today

Another Complaint to Kwik Fit 05/07/2012

 

Hello,

 

I am exceptionally dissatisfied with the work, carried out by the Birmingham Kitts Green Branch.

 

So far I have had 4 New tyres fitted from there one of which won't hold pressure.

 

I also had my front disc brakes replaced during which my drive shaft was broken and replaced (at Kwik Fits expense)

 

I have now got a squeak from the front offside disk which is gouged and scored, making me wonder what has happened as the front near side is completely smooth as you would expect on a new set of disk brakes.

 

When I took my car back for retracking my reception at Kitts Green was hostile to say the least.

 

The tracking was not carried out satisfactorily as the steering wheel is no longer level

 

In addition imagine my surprise when my car recently under went an MOT and I got a caution on my drive shaft boot.

I would think 'broke' is the wrong word for the driveshaft, but to have damaged it beyond use shows exactly how 'amateur' they are.

Kwik Fit may I ask why you answer other peoples issues in these forums but I have a thread and answered in another thread about you plus emailing you a million times over plus letters and you STILL ignore me??! I'm totally frustrated now with no contact from you! STOP ignoring me and provide me with a solution for my issue with you!

Hi Andy,

 

Thanks for your reply but we already spoke to your area manager about it who advised us Kwik Fit wouldn't do anything after several phone calls with him/customer services and that we should just go to the small claims court if we want our money back as Kwik Fit didn't want to know.

 

We spoke to citizens advice and some other sources who advised with our evidence we had a extremely strong case so the claim was issued Monday by the court so there's not much more to say on this forum.

 

We sent emails to the address above you supplied plus the main customer service email address plus rang/sent letters etc so it's 'odd' how they never got through. The claim has been issued and we await our money back.

It's just as well you aren't doing this through the advisor on here. When people are asked to contact KF, they are never heard from again. I think they dump you in the deep freeze or a big pit to keep you quiet, so you have had a narrow escape. :D

Ah there's nothing they can do to keep me quiet! :razz: Although I think you might have a point about the pit :wink: It's amazing though when you speak to people how many people have had bad experiences with them- it's scary!! x

Hi Andy,

 

No we never received a letter back to our three letters sent to you or any replies to the four/five emails sent to different email addresses including the one above and no information over the phone. That's one black hole for upset customer communication you have there at head office.

 

As for our address, it'll be on the court issued claim so if you want to send us a cheque etc for the money I suggest you take the address from there otherwise there is nothing more to communicate about.

We received your letter today but rather than send a email or letter which will never be seen again I'm writing the reply on here so I know you see it. First of all your excuse of sending the letter to a Mr Johnson instead of myself as he was on the receipt for work was awful, Mr Johnson is my partner and lives at the same address so I fail to see how that would stop the letter getting to us? Second of all my name plus address was on all correspondence so not overly sure why you got his name off the receipt?!

 

Right to the letter, so I wanted to check first of all you had the right couple. In the letter you say you did the work 'according to the MOT failure sheet' we presented. OK will this is news to us we have all our MOT sheets ever and we have never had any failure on the roll bar, CV boot etc plus the fact the car was MOT about a week ago since Nov 2011 so how you got that info I have no idea.

 

Also Simon was the guy who Mr Johnson spoke to who told us quite a different story to your letter. The one who advised small claims so no we won't be phoning him for more lies thanks.

 

We took the car in with the noise and drove out with the noise. The car was driven out at around 5 and my partner had to collect me from work, we we're going to take it back the next morning because by that point we were advised you we're shutting but I thought to myself...you know what it's my car, I've heard bad things since I mention KwikFt had our car....I'll get a second opinion. SO less than 12 hours later at 8:30am Pro Tyre were checking the car and told me you had completed the work wrong and also missed the broken roll bar which you could NEVER have missed as its right next to what you 'fixed'. Never mind the fact you gave our car back broken without test driving it first which is awful. Which by the way loved Simons statement of 'trusting his boys and they would never give it back untested'. Well they did it made a bad nosie going in, was still doing when it came out. It's not rocket science- they lied.

 

Pro-tyre did fit different parts to what you did as you didn't fix the problem!! You carried out unneeded work! You also ignored a broken roll-bar which is pretty dangerous but yes of course you told us to come back then you could fix that and bag more money! Excellent for you guys!

 

Now, I've had my letter through which informs me you have until the 1st Dec to give us our money back or we go to court. We now have in writting your lie and all our proof so in fact anyone can see more than ever your lying.

 

Do what's right for once, stop lying and return our money. Sorry but we're not going away and taking your lie upon lie.

 

Oh and you can reply on here with some more lies etc if you feel but you won't hear from us again now, your letter only helped us to prove our case. Thanks.

 

Look forward to receiving our money rightfully back.
