Hi All

 

I have been working on a small refund of charges for my daughter of £111.00 and sent off 1st letter on 18/09. Received offer of full settlement today!

 

However offer letter states - "Acceptance by you of this payment will be in full and final settlement of all claims you may have relating to our charges. However, our Terms & Conditions will continue to apply and any charges that accrue in the future must stand"

 

By accepting offer will she be accepting future charges to the account and not be in a postion to reclaim them?

 

Anyone else received such a letter?

If their charges are still excessive in accordance with UK law then they cannot apply them. Natwest cannot "overwrite" UK law just by putting a clause in their T&Cs if you like.

 

Of course, Natwest are allowed to apply the charges - just not to the excessive amount that they currently do, so I'd say that should your daughter receive any charges in future, she would be in a position to claim them back as normal.

Mousewife's right, but to make it crystal clear. Write an accepatnce letter with only the conditions you agree to including something like:

 

I accept your offer of £XXX as full and final settlement in relation to this particular claim.

 

I reserve the right to challenge and persue any future unlawful charges.
