      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I am a newbie on the site and was wondering how you are getting on withPayday Express, as I have finally received an email on my situation with themfrom the Customer Relations Team, Just a quick update on the loans I have outso far:

Payday Express £715 (Please see below, Regional Loan was £400 + £100Interest)

Wonga £295 (Customer Relations are Investigating)

1 Month Loan £495 (Regional Loan was for £300 + £90 Interest, I have paid£105 so far and have got a settlement figure of £290 on the 27th March fromthem to close account)

Lending Stream £1795 (Not heard a thing, about 5 emails sent)

Mackenzie Hall (Quick Quid) £895 (Not heard a thing, about 5 emails sent)

Letters and emails have been sent to all of the above to be put on a paymentplan so I can finally close these accounts and never and I mean never use thesecompanies again!!!

Payday Express have said if I pay £300 in a pay plan that will settle theaccount, but I have already paid £400 in roll over fees to them, so should Ionly pay £100 pound more and that is it or should I pay the £300 in instalments?

Hope someone can help a man in need??

Hello,

 

Can anyone help with Wonga, they have not got back to me and I have sent about 7-8 emails, also if for example I have paid £400 in roll over fees with Payday Express (Loan £400 Interest £100) surely I can pay just the £100 pound more and close the account?

 

The loan amount is at £715 at the moment, but they will except £300 Payment plan. Now should I take this or just pay the £100 to them?

 

Hope someone can help a man in need ;-(

Just wrote to them and tell them what you can afford as repayments. Dont leave yourself short as it is considered a low priority debt.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Thanks for the reply, have made an offer of £150 to Payday Express to close account instead of the £300 that they wanted.

 

Waiting to hear back from them, also still have not heard from MacKenzie Hall, any suggestions?

Sid! Please let me know how you get on with payday express! To be perfectly honest... I'm astounded that they've agreed to settle at £300 and take the extension fees into consideration!

 

I wouldn't even like to work out how much I paid them in rollover/extension fees. I know it's somewhere in the region of 24 months x £100 on a £400 loan. And they claim I still owe £660..

 

This opens a can of worms if they are agreeing these offers for some people, yet continuing to bend others over and have their wicked way with others..

 

Please, keep us updated. I'm considering stopping payments to them and telling them to 'bring it on'

Thanks Bombaymix - exactly how I've felt along while I read it that they still want £300.00 on top of any roll over fee's paid Think some of the posts are misleading (even my own would have been in the start as I didn't see their game until the last payment) Lets not forget even Mr PDL press man Steve Perry stuggled with this lot (named as 2 he was left in limbo with) Chin up lad, try not to let it rile you and remember you are doing doing the right thing - which will ultimately become your 'weapon' Your money is get backable

Happy to share my experience but for your own protection, please check and double check what myself and other Caggers inform

Hello Bombaymix,

I have just had a reply from Payday Express and they are not budging on the£300 to close the account so should I just go on a payment plan with them forthe £300??

This is the breakdown of the loan:

£400 Loan

£100 Interest

£400 in Roll Over Payments

£715 still owing on the account

So instead of paying the £715 to close the account, they are letting me pay£300.

Should I pay the £300 and close the account??

Because I was reading one of the post on here and the person said that PDEwrote off the loan as a goodwill gesture.

Not sure what to do, need some help if you can?

by your own words Sid u have a discount with the £300 if yr meant to be paying £715 or £500

do you really believe all dat you read on the net? i wouldnt , anybody could put they've have a loan written of, one way to find out why don't u base yr complaint on this logic -on what you've seen see what they have to say? go on could be interesting a message in a public place stating this fact as right it is in one of the threads today- time to throw it at them? after all do it for one they would have to do it for everyone before it causes public outrage alone :madgrin:

Hey Sid.

 

I really don't know what to suggest.

 

As I said, PDE have had nearly 2.5k from me over 2 years in rollover/extension charges and still claim I owe them £660 on an original £400 loan.

 

They took the best part of 3 months before they'd accept a repayment plan.

 

If I thought I could use this as a valid argument against them, I'd be requesting a substantial refund!

 

I really don't know. I'd certainly be happy to not pay them another penny. I can honestly say they were the worst payday loan company for me to deal with. Rude and abrupt on the phone. Telephone harassment, unanswered emails and then accusations that I wasn't making contact.

 

I'd be reluctant to strike a deal with them unless it's totally on your terms. You never know, they may be trying to tempt you to making a £300 payment and sending the remaining balance off to a DCA. I'd put nothing past these vultures.

 

Personally, if they'd offered me ANY discount, I'd have paid it. I'm not that lucky. I'm lumbered with £660 to pay and the reminder of my stupidity on my CRA files for the next 6 years.

 

You live and learn though... Nobody forced me to apply for the loan in the first place. I've learnt a valuable lesson... Payday loans are NOT the way forward lol.

 

Hopefully some of the other guys will be along to offer some advice. And if any of them feel that I should send them a letter telling them they've had 2.5k on their £400 loan and to stick the £660 where the sun doesn't shine - any support on a approach would be most welcomed.

Do not pay them any more money, trust me keep emailing them everyday tillyou get what you want!!!

You have easily paid what you needed to and more, I would even try to claimback some of these charges that you have paid.

Please Please don’t give up, keep fighting.

Payday Express have got back to me this morning and have it in writing thatI will pay £100 on the 27th March and £200 on the 27th April, also confirmedthat they will not pass on the rest of the debt to any debt collection agency.

Two down three to go!!!

1 Month Loan have agreed a one off payment of £290 on the 27th March toclose the account (Amount owed was for £495)

Just waiting to hear back from Wonga, amount owed is £295.00 (Have offeredthem £235 to close account £135 on the 6th April and £100 on the 27th April andthat should close the account).

2 Left and these are the hard ones:

Mackenzie Hall (QuickQuid) £895.00 outstanding

Waiting to hear back from them after 10 emails!!!

Lending Stream £1795.00 still have time, will not default till the 30thMarch

Also waiting to hear from them as I have sent around 10 emails as well.

All in all getting though this slowly, but thanks to this site will get themin the end!!!

Debt Free by the end of the year I hope!!!

Hi Sid, You may have tried this already, but there is a Request Callback option on Mackenzie Hall's website. I've dealt with them before, and they were (as far as DCA's go) quite reasonable in terms of payment plans.Good luck with your hunt!

Just an update on Wonga, have got back to me with a offer of £218.77 to close the account (£295.00 owed) to be paid on the 6th April.

Mackenzie hall are [problem] artists. They cant and wont do anything. Theres even an official investigation into their company.

Sid! A little bit of advice RE: Lending stream.

Are you on Facebook? If yes, join their page and kick up a chit storm on their wall. They hate confrontation in this manner and will give in straightaway to look good to their army of happy customers *_* lol.

 

I enjoy logging onto their page and seeing the most recent rants and their grovelling apologies! Very therapeutic knowing that you've questioned their business practices on their promotional page and they've dealt with it. I suppose this looks quiet good to them? A customer complaining and them bending over backwards to sort it out.

Thanks guys. I obviously don't have the magic touch. Tried that contact option with no joy at all. They are treating me appallingly and i'm actually crying as i type this. I feel such a bad person xxx

 

Payday are notorious when it comes to replying and/or acknowleding anything you send their way unless it involves £ signs. It's been two months and they still haven't acknowledged my DMC while all the time continuing to try and charge my card.

 

Keep at it, I think PDE have a 1 business day turn around (worth checking that on their website) when it comes to dealing with complaints. If you don't get a reply, just send it again. Might also be worth having a look round to see if there are any other email addresses you can send to. If necessary, send your correspondence to every email address you can find.

 

Also, might be worth thinking about the old fashioned letter. Make sure you send it by recorded delivery so you've got it for your records.

 

Remember to keep a record of EVERYTHING you send, and avoid telephone calls at all times.

 

I know it's difficult, but keep your head up, you're in control here, not them!
