Hello

 

I am new here and not sure where to start.

 

Basically I have taken payday loans from Wonga, Lending stream, Quick Quid and Payday Express.

I have sent each letters and emails in January asking fo a payment plan but still havent got any results from it. Wonga asked for a a list of income and expenditure wihich I have sent 3 weeks ago and have not heard from them since. Lending Stream has agreed to a monthly payment of £20 but refuced to freeze interests. QuickQuid offered me a payment plan for £138 a month istead of £20 which I can not afford and Payday express is texting me every day and I am receiving at least 5 automated calls every day saying to contact their office even tho I have sent out about 6 letters and many many emails no one is replying me and the text messages are mostly the same. We have not hearr from you regarding your.... You probably know what I mean. I am now receiving calls from their debt recovery dept. When I picked up the phone they said they cant exept the offer and asked them to contact me by email. Still receiving calls which I am ignoring now. Sent my last emails out again today.

 

Please could you help. I am not sure if I am doing things right. Should I call them?

Do you have an answerphone that could screen your calls or does your system allow you to block some numbers ?

 

I would stay off the phone unless you are in a position to record the conversations.

 

Send one letter to each of the creditors confirming you are unable to make contractual payments. That you are only able to make payment of £X amount, that you would like them to freeze interest and charges and that you require them to do you the courtesy of responding within 7 days.

 

Send your letters via Recorded delivery post if you can afford it, but at the very least do obtain a Free proof of posting from the post office and keep it attached to a copy of the letters you send.

 

They will no doubt make lots of threats, most of which will be in breach of OFT guidelines - stay firm and off the phone.

I do know that u should never send any of them ur expenditure details .they are not entitled to any of that and never ever give them ur banking details and if u haven't done so yet cancel ur bank card asap tell bank its lost and order a new one and cancel all direct debits to any payday loan company because as soon as u tell them u can't pay they may possibly raid ur bank account like quick quis did to me and many others so first of all sort ur bank out then default with all of them and if they won't set up a payment plan then it will go to a dca but don't worry thatl be fine as u can pay a lower sum but stick to ur guns on what u can afford to pay and don't give in to bully boy tactics ok so nows the time to tell the payday lenders u can't pay anymore until a plan is in place ,chin up we have all been here and much worse ul be just fine with the advice u get off us all I promise now stop worrying get a drink of tea and have a good nites sleep de stress and be firm with em all ok ,see u soon x

Great advice. Thanks.

I have closed my new bank account and opened a new one. If my loan will be passed to DCA will they add any extra charges? I have just received another email from QQ this morning:

 

At QuickQuid, we value your business and ask you to contact us immediately to resolve this matter.

 

If we do not receive payment or a response from you with alternate arrangements, we will take appropriate collections measures which may include, but are not limited to, the use of a third party collections agency or sale of your debt to a collections company.

 

Notices

For so long as you continue to be behind with your payments by any amount, you will be sent notices about this at least every six months. We are not required to send you notices more frequently than this, even if you get further behind with your payments in between notices.

 

 

If you have already made payment arrangements for the loan, please disregard this email.

 

 

Office of Fair Trading Information Sheet

This notice should include a copy of the current information sheet on arrears prepared by the Office of Fair Trading. This contains important information about your rights and where to go for support and advice, for example on applying for a Time Order as well as our right to charge you interest. If it is not included you should contact us to get one. Please refer to the Office of Fair Trading information sheet for more information about how to get advice on dealing with your debt.

 

What would you reply since I have been contacting them several times in the last month with no answer.

You just need to say pretty much what you have above. Something along the lines of..

 

Dear Sir or Madam (or named person)

 

I am rather concerned that you claim no contact has been made from me. This statement is untruthful as I have contacted you on the following dates :

It would seem to me that it is you who are not responding.

 

I repeat my request for a repayment plan that I can afford due to the reasons I have already explained.

 

etc, etc.

 

Keep it short, bullet pointed and factual.

Looks like the finally woke up. Just received a second email from QQ:

 

Thank you for contacting us regarding your account. Our records indicate that you have a past due balance in the amount of £570.17. Unfortunately, we are not able to accept your offer to pay £20.00 per month. If you are working with a Debt Management company, please forward all of the following Debt Management details to us: Name of Debt Management Company, Name of Representative, Phone Number and Reference Number.

 

Should I reply anything to that?

Are you in a debt management plan or are you DIYing ?

 

You might want to sort out a DIY plan that is accepted and backed by the OFT - have a read of the following and use the tools provided to produce your own budget sheet (for your information only)

 

Have a word with one of the CASHflow contacts listed below.

 

Then contact the PLD company and confirm that you are only able to pay £X amount.

 

The following has recently been brought to my attention and could prove very useful. Especially now the OFT guidance specifically states it's an Unfair practice to ignore a cashflow budget!

If you are experiencing difficulty in repaying your debts, CASHflow is a way for you to negotiate affordable repayments with your creditors. Before you can use CASHflow, you must have spoken to one of the free advice agencies licensed to offer CASHflow to their clients. The advice agency will start by talking to you about all of the options available, and can help you to decide if CASHflow is the right one for you.

 

If you decide to use CASHflow, you will be provided with all of the tools you need to be able to complete your own financial statement and negotiate offers of repayment with creditors yourself. This will enable you to stay in control of your situation, but still have support from an adviser at any stage if you need it.

 

You can contact a local advice agency to check if they offer CASHflow. You can find a list of free advice agencies that are near to you by searching for a money adviser in England or Wales, Scotland, or Northern Ireland.

There is the new CAB system that might also be worth a look, this system saves all your details, has guidance allowance figures to work with if you wish and you do not need to be invited / signed off etc with this system, just log in and away you go (see below)

 

(Also, there are a number of other self help tools and systems around so might be worth a little exploration if this is what you eventually decide on.)

Theoretically, you are supposed to work out what your disposable income is after all priority expenses have been accounted for. That disposable income should then be allocated on a pro rata basis to each of your creditors.

You should not be paying extra money to those who shout the loudest.. it is unfair to your other creditors.

I am not with a debt management plan but I have asked for advice at the national debtline and payplan before and have been following all there advice. I have worked out on one of there pdf how much I can afford and since I got 3 more payday loans I can only afford £20 a month without putting myself into more trouble.

Then that is what you tell them :)

 

Just confirm that having spoken to Nat Debline and in view of the fact that you have other creditors both secured and unsecured this is the amount you have to offer.

 

You would like them to freeze interest and charges as well.

 

Sadly, it is a case of who blinks first..

:cheer2::target::bathbaby:hello and fantatic on sorting ur bank account out u did great now if they send them to a dca do not worry this is probably the best thing for u as u can usually get the amount u want to pay but remain firm with them but keep at it with qq stick to ur guns and ul get there and be free soon.please try not to stress i was in ur situation too and panicked but with help from this site i gave it my all and now im pdl FREE and u can be too soon xxx:whoo:

Can someone please help me with below email I have just received from PDE?

 

In response to your recent email, thank you for telling us that you have fallen into financial difficulties. To allow us to process this on the system could you please send us a copy of two months worth of bank statements plus return the income and expenditure form we have attached for you. This is so we can assess and work positively with you to processing a small repayment plan for you.

 

Dont think they should ask me for bank statements.

No and dont send them to them

 

Correct. They do not need or will ever need to see anything to do with your bank statements. All they need to see is a simple income and expenditure form. That's it.

 

The only person(s) that would have any reason of any kind to see any information relating to your bank account is a judge should your debt ever go to court ( it wont), and even then, only the judge will look at it. Nobody else will, due to the data protection act.

 

And i say it will never go to court because so far, no PDL company has taken a debtor to court, or even got past the initial appraisal stage.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
