hi new to site:| i have a few payday loans not sure why i did this i have nothing to show for lending the money i keep asking myself why why why:-( anyway it has got now that i have now defaulted on my loans cancelled my debit card so no payments came out so now chasing for money i have email each company to advise on my financial situation and offering them a payment that i can afford each month some have agreed 1 month loan 20.00 fine mr lender 15.00 fine and liquid 20.00 but the others i am finding very difficult to get a response only the normal if you dont pay then add charges and interest will be applied or legal action will be taken and will send around a debt collector to your house which i am more scared of as i have not told my partner i feel sick every time a car pulls up and my heart is in my mouth all of the time, reason for telling my partner is that we would end up spliting up i dont want this to happen it would break his heart to think what i have done i normally do all the banking and sort out all the bills and what we have left is what we live on, however i think i got to a stage and thought sick of struggling month to month so got payday loans as my credit rating is poor, but now even more in debt i have now been intouch with payplan just recently so still very early doors, but my main concern is door collectors and what happens if the creditors dont except the payment offer offered to them

Door collectors have no powers, are not bailiffs and should not be allowed in. You also should NOT sign anything on the doorstep incase your signature is misused - no real evidence on this but best be safe rather than sorry.

 

There are template letters available in this forum which you can use to tell the companies not to send people round.

am i better to send the letters now before they threaten to come to my address mini credit have already sent me letter stating if full payment of 1099 is not paid in full by te 23rd feb then will be passed to the door collectors which they have already put add charge of 100.00 for this, once the letters have been sent can they still turn up do they take any notice of the letters

Send the letters now, don't wait for them to hassle you, that way you have proof that you tried to come to a sensible arrangement at an early stage and they did not co-operate.

 

Put the letters/emails in your own words, rather than use templates which sometimes just make the company more annoyed, keep it short and sharp and they can do nothing. Examples below..

 

 

Do not call/send somebody round letter

 

Please do not call me about this matter, I will deal in email or letter only, all calls will be automatically recorded without further notice. As a consumer I do not need a licence to record telephone calls.

 

Also I am revoking any implied authority you think you have to send a doorstep agent to my address, you are NOT allowed to send them to a work address.

 

Any breach of the OFT Guidelines on Debt Collecting will be reported immediately to the OFT and Trading Standards without further notice.

 

That short letter should help, keep it simple and they will be more co-operative (hopefully).

hi just got letter from mini credit stating final doorstep notice and that someone will be visiting me between the 7th and the 14 March inspite of me sending the template letter to them now i am scared

i have now started a dmp for my paydayloans but reading some of the comments certain lenders can be difficult how do you get round this even though the dmp will pay some amount to them although wont be a alot but it will be some monies going to the lenders what really can the payday loan companies do to me

If anyone turns up they have no rights and you can tell them to vanish. Do NOT fall for 'sign here to say you have seen me' just in case it is misused.

 

They have NO RIGHT to send anyone and if they do then a complaint to the OFT is in order pronto.

i have been reading some of the horror stories about min credit sending court summons but not heard anyone going to court but rec papers for court summons also as said with dmp now but mini credit dont deal with third parties its a viscous circle with mini credit, i borrowed 400.00 but now with the interest and df charges and now two lots of doorstop charges is no over 1,000 this cannot right first letter for the doorstep 100.00 but no-one came just rec second today with dates on when they might turn up with 100.00 charge on do i contact oft about this but what can they do

The OFT can stop them trading, they are not allowed to charge £100 for a doorstep visit.

 

Your complaint could be vital.

 

Phone the OFT up and explain what has happened, they are doing an in depth investigation of this market. You might be asked to do a witness statement, this is perfectly normal and means they are taking complaints seriously.

 

Minicredit could loose their licence if enough people complain about their behaviour.

thanks i have emailed them regarding the above find this better than talking sometimes give them what information i had did rec acknowlegement email back was advised they are dealing with lots of issues regarding debt collections can take up to 10 working days
