Why the courts dont come down hard on that idiot is beyond comprehension.

Well the case got stuck out because he didn't turn up to court,

but i did bring up alot facts and the judge did have a few questions to ask him and how he was going justify charges and the fact there's no charges in the contact i signed and that he cant have 2 sets off terms and conditions

 

But if u do have any ccj always go to court..

Typical. Knew he`d lose so cowered away. I hope you applied to have him pay all costs and possible compensation.

and he made the claim but didn't defend it, even his witness statement didn't make sense to the judge, but yeah the whole claim was stuck out and he will have to pick up the court charges as there was no judgment made against me

Presumably in respect of the comments made by the Judge, then the charges are going to have to come off the debt. So Luke could probably work out if there is still any thing left to pay :)

I would have asked the judge to grant costs and compensation due to it being a false and malicious lawsuit plus the ongoing harassment and threats.

 

But at least its done with now .

well if i have to go court again for this , then i will to a counter claim against him and get a lawyer,

 

as this is the 2nd time this ccj has been stuck out

 

1st time he never replied to the court papers so didn't go to court

2nd time he didn't turn up

 

3rd time.. unless he has a really really really good excuse for not going or sending some to represent him then.. in my mind this debt is settled

If he does it again and doesnt turn up, ask the judge to issue a summons for questioning. If he doesnt turn up and explain himself then, he will have a guaranteed short jail term.

 

the judge might grant it too since ot would be the third time he has made a mockery of the court system and tried to gaina ccj on a bad debt.

I expect he never truns up at court because he only issues court papers in the hope you will get scared and not defend, that way he gets a CCJ by default and then requests a warrant of execution.

I will also urge you to report this to the OFT, a few years back 1st Credit got into trouble for issuing stat demands and not appearing in court to follow them up....this is very similar.

42man, Andrew hart is very well known for doing this. he inflates the debt to obscene amounts, then when he knows the debtor is panicking, or doesnt know their rights, he starts court action, which inevitably leads to a CCJ as the majority of people have no clue about court forms, and then on to warrant of execution. It's how he made himself a millionaire and is now going into property development/management.

If he issue's these claims against people, but never turns ups, then surely it's a waste of court time and a complaint should be raised with the local courts that he uses.

Anyone with evidence against Hart should be complaining to the courts and OFT. Only way to stop him

as i said earlier if he doesnt turn up, reference this forum to the juge and ask him to issue a summons for questioning.that forces him to appear and explain himself. If he diesnt turn up then its a guaranteed prison term for him for contempt of court.

I was always under the impression that if you didnt appear for a summons that it was classed as contempt of court which means a short sentence.
