can you post up the letter please

 

scan the required letters/agreements/sheets

as a picture[jpg] file

remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

 

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

then hit reply button

Hi,

 

I appreciate you are a little vague, but it is possible that because you are over your limit and more importantly havent paid them anything at all for 8 months, they have defaulted the account and passed it either to their collections department or a Debt Collection Agency.

 

If this is the case they are probably offering to freeze interest and charges for a specified time to encourage you to enter into a payment arrangment with them.

 

They would prefer to keep dialogue open with you and and to receive some payment each month rather than nothing at all.

Okay another letterfrom Halifax confirming that they do not have my signed CCA along with 6 refs to current and recent court cases where no CCA is required! But they did confirm that the debt will not become void it merely stops them getting an enforcement on the debt from a judge

 

So my aim is not debt avoidance by lack of paperwork but what do you think i should reply to this..Shall i try a full and final?

 

At the moment i pay them£10 a month and owe £2150

Okay sorry for the delay in my response. My scanner is playing up so i will type the letter word for word.

 

Dear Mr XX

 

Further to your letter dated 29th December 2011,at the moment we are not able to provide a copy of the original signed agreement,however we can confirm that our procedure has always been to obtain our customers signature to an agreement containing a prescribed terms before entering into a credit card agreement containing the prescribed terms before entering into a credit card agreement. As such, we are confidant the agreement remains enforceable.

 

By providing you with documents attached to our previous letter,we have satisfied our obligation to provide a copy of executed agreement under section 78.

 

However even if an agreement us unenforceable, the contract still has legal effet and is not void, thelender is merely prevented from getting an enforcement order from the court. it has always been our process to ensure that an agreement complying with the CCA requirements would have been signed by the customer before setting up a credit card account. Should this matter proceed to court we will adduce evidence to confirm this.

'consumers have a right to information on debts they owe, but it is important they they realise that theses sections of the act cannot be used to write off legitimately owed debts' The OFT have also issued a reminder that even if a agreement was to become unenforceable, customers will still owe any outstanding money to the lender, intrest and default charges can still beadded to the loan and any failure to pay could effect their credit record.

Yeah DX as soon as i read it i thought omg scare tactics overload

 

Anyway a bit of a history

 

I have claimed PPI back that helped me to settle my other credit card i had with them they had a signed agreement for that!

 

Okay some info on this debt is:

 

Balance: £2096

credit limit £2000

intrest rate: 11.9%

Arrears £334.22

Date opened: No information as no CCA provided

when is the default date from the cra

and there must be info on there of how old the account is. too.

Right looking at my Credit report

 

Status is late payment and not showing as defaulted. I am 6 payments behind that is up until Januray so i am now 8 payments behind

 

Opened in June 2006

 

Anything else you need Dx

have you ever SAR'ed them and looked at penalty charges etc on this card

 

would really like to know the age of it .

 

if its pre 2007 too

what about penalty charges & PPI

 

get it down a far as you can

 

then offer a low F&F
