      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I took a loan out through payday uk last July for £280 and every month have deffered my loan for £70 per month so they have now had £420 off me in total. I have now decided this is ridiculous and something needs to be done to get out of this mess. I have contacted my other payday loan company who have set up a repayment plan no problem. However, payday uk are awful to deal with.

 

My loan became due on the 16th feb, I emailed days before that to say I would like to set up a repayment plan only to be told I would have to wait until I default on the 16th and then I would be contacted. The day before this I lost my bank card so conveniently cancelled my card and am awaiting a new one. On the morning of the 16th I checked my online banking to see £70 had been taken It was payday uk! I rang them straight away and they explained they try for the full amount if this didn't go through they take the £70 this was not stated in the email I received earlier in the week!! I was then told a repayment plan couldn't be set up now until my next loan due date and when I default so I left it at that. A bit later I received a text saying payment hadn't been authorised checked my bank again and the £70 had gone back in my account - phew!

 

The next day the phone calls started I spoke to two people regarding a repayment plan the second girl told me I could have one over 3 months for £93 per month I explained this was unaffordable for me she explained the system wont let her do anything more than that and slammed the phone down on me - great! I have sent two more emails proposing a payment plan - each has been ignored! And lastnight I checked my bank and they've cleared another £70 out of my bank - im hoping today it doesn't get authorised again as I get it back like I did on Friday. I have also sent another email to them. Am getting really fed up with this horrible company and unhelpful staff. Any advice on how to deal with this would be appreciated

JamieLeigh87HANG UP THE PHONE WHEN THEY CALL. I once slammed the phone down on them back in the early days and they never tried contacting me by phone ever again ! No emails either so I stuck to good old letters Compose a letter of complaint if you've not already done, state what you have worked out as could afford to pay - in the subject line or header with the words FORMAL COMPLAINT Contact the Consumer Finance Association (their trade body) who may tell u they don't want to get involved, but will tell PDUK you've been in touch weirdly enough and this seems to worry them a bit ! After weeks of going round in circles watch this lender do a massive u-turn as long as they cannot access your money ! After 3 months PDUK claim to transfer your account to Keyes Whitlock (really thats their inhouse collection guys) if not paying their minimum payment amount

Happy to share my experience but for your own protection, please check and double check what myself and other Caggers inform

just an update. received a letter from customer relations at mem-fc group to let me know they had received my complaint regarding PAYDAY UK and will investigate it and i will receive a response by 21st march.

 

Yesterday i had £128.75 debited from my account by payday in 4x £25 and 1x £28.75 a

 

and again today of £25 and £63.18

 

This was my child benefit money that they have taken and I now have very limited money to get my child nappies and formula milk I feel sick to my stomach.

 

They have now taken in total £706.57 on a £280 loan. I have tried calling customer relations left two voice messages today for a call back - not heard a thing, sent numerous emails too and not one response.

 

Really need advice on what step to take next with these sick people!

How did you get on? Did you hear back from them? Im in the same situation, they have took over £600 from my account. I am so angry...I am definately going to take this as far as I can. Hope you managed to sort things out

When did they take the money I don't know how they can sleep at night taking that kind of money from people's accounts. I rang them and played hell with them for taking money, they paid it back to me took about a week, and then I got passed to the customer relations department as I made a complaint and they helped me set up a repayment plan of £20 per month

I rang them and played hell with them for taking money, they paid it back to me took about a week, and then I got passed to the customer relations department as I made a complaint and they helped me set up a repayment plan of £20 per month

 

Make sure that repayment plan is writing ;)

They took the money on Monday as soon as my wages hit my account! : ( No money back so far! I had an indepth process with the customer relations department yesterday and felt like I was going round in circles! I know I shouldn't talk to them, but when I spoke to the normal department she said she would create a complain so wanted to make sure of this. I should recieve a letter today or tomorrow to say its been registered and then could take a few week to come to a decision!!?? How did the process work for you, did you recieve a letter? Did you get your money back before you delt with customer relations? Glad you got sorted in the end : )

It's very unlikely you'll hear anything back. You need to write to them and header the letter "FORMAL COMPLAINT". Outline your complaint in the letter/email and that automatically gives them 8 weeks maximum to give you a final response. Then you can take it to the FOS who will investigate your specific case.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
