They are a Debt Purchasing and Collection agency.

 

Have they not made it clear what they are pursuing ?

 

If you believe you know what it is for, can you recall the last payment you made to the account. 1st credit and others have purchased quite a few statute barred debts just lately..

 

Statute barred debt - if no payment or acknowledgment of liability has been made for 6 years from the first missed payment.

 

Your choices are :

 

Ignore until they make it clear what they are pursuing

Send them a letter (template in CAG library) suggesting they prove the debt is yours and owing.

Send them a letter from the CAG library asking them for a copy of the Agreement.. it will cost you £1.00 and is called a CCA 1974 request.

Debt purchase and debt collection group

Have they actually stated in letters or e-mails

exactly what they are chaseing if not ignore

them until they do.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

More history please, have you checked your credit file? Is there anything on there regarding this?

How old is the card?

When did you last pay anything toward it?

 

What do their empty threat letters say?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

There is nothing showing on credit file as of yet. The card is 2 years old and last payment was sept 11. They are just looking for me to sort out payment at the moment.

 

The figures match the vanquis balance exactly but there is about 100.00 late payment charges. Can I do anything about them?

You can reclaim the charges.. but it looks like you are going to have to come to an arrangement with them if the card is only 2 years old.

 

You do need to have it confirmed that this is the account they are chasing though. Were you sent a Default notice from Vanquis. Seems a bit quick for them to pass this on to a DCA if the last payment was made in September 2011 ??

Oh well, as CB says, you will need to come to some arrangement with Vanquis and set up a repayment YOU can afford, and is realistic to YOU, not them, they have no say in the matter, you hold the purse strings not them.

 

As for the charges they have added, you can either go about reclaiming these, or simply, pay what you physically owe, and forget the rest.

To tell you the truth I don't know if I got a default letter as I just ignored and shredded everything that came in.

 

I have had 2 ccjs in the last 5 months so that may ne the reason. I missed a payment in august and paid double in sept.

 

I changed my phone no too at this time as after the august payment they rang about 10 times a day.

 

Does anyone know their bank details so I can set up a standing order to make payments without contacting them?

You complete the spread sheet below..

 

 

Then just send them a letter with the spread sheet asking for them back.. That will be to Vanquis.

 

You then need to write to 1st credit and make your offer and ask for their bank details in order to arrange the standing order. They might try to blag you that they can only accept a Direct Debit.. DO NOT even think about one of those.. Standing order only.

I don't have any statements, do vanquis have to supply them to me

 

You would need to send Vanquis a Subject Access request and specifically request statements as one of the items you want. You can find a draft letter in the CAG library.

 

The request will cost you £10.00 either a postal order or cheque. They have 40 calendar days to comply with the SAR.

 

Do you have access via the internet to your account ? If so, then you could print off the statements from there.

Got a letter from them today dated a week ago advising it is definatly vanquis. It offers discounts to pay within 7 days 30 days and 90 days. I can at most offer 5.00 pw. How do I proceed

There is a letter in the CAG library regarding offering a token payment and asking for interest to be frozen.. You will find the CAG library at the top of the screen, green link :)

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
