      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

Well i'm on my way, just playing the waiting game at the moment! Posted my Prelim letter on 19th Sept '06 as of yet had no reply, so i've now got my LBA ready & will post this on 3rd Oct.

This is so much fun!

Luckily i'm a natural hoarder so had/have bank statements going back to 1996, but it wasn't until i was doing my schedule of charges i realised what EDIT %%^%*&%%& they are! eg:-

Unpaid DD £1.99 Charge £30.00

Unpaid DD £1.99 Charge £30.00

Unpaid DD £9.58 Charge £30.00

All on the same day!

 

I had a loan with them & due to being a single parent on benefit i was paying it back weekly via S/O (in line with benefit going into account) So when i got myself a job & realised that what i was earning was being eaten by charges i got my account back into credit & swapped banks, paying in £60.00 per month to cover loan S/O, within 4 months my account at RBS was £260.00 O/D via charges :p .

 

This then obviously sent everything else back, so i ended up with depression & back on benefit.

 

I've calculated that in 6 yrs they have taken £4,646.42 :eek: in charges & the best of it is that out of those 6 yrs i was only employed for a total of 18 months :smile: .

 

Roll on Tuesday 3rd October. Bring it on!!!!!!!!!!!

dont let them get you down. look at it as a savings account and in a few months time you'll be able to withdraw all your savings. welcome on board.

Don't worry not letting them get me down, quite excited actually even more so when i recieved my bank statement today & they are going to charge me £28.00 + £6.50(interest) for going O/D for about 0.000000000000000000002 seconds!

I think we are running on the same dates except I'm waiting for my statements to update at LBA stage, why wait I say.

Hi Warah,

What stage are you at? prelim or LBA?

 

You'll get the same....we believe our charges are fair and transparent.....groan groan response. I recommend either RD or getting a certificate of posting which is free when sending any letters. Remember to send the LBA when you get a response or after the 2 weeks have passed. same for when you file your claim and at this point don't forget to add the 8% interest and send a schedule of charges plus interest to the bank also.

14/09/2006 - Data Protection Act letter sent to my bank.............here goes :D

28/09/2006 - Statements received through the post. Charges appear to be in the region of £2000 :eek:

Morning all,

 

Need some advice & i know i will get shouted at for asking but valid excuse believe me.

 

Sent my LBA 3rd October, do i now need to get forms from court or do i do money claim?

 

Excuse for asking, my youngest daughter has given me her cold, my body has stopped functioning, my brain is full of snot & is thinking of moving out (just managed to drive them to school this morning, I THINK!)

 

Any help will do, just don't get to technical as words look like pretty shapes at the moment & its just taken me 20 mins to type this!

So, you sent your lba out on the 3rd of October? then when the clock rolls around to the 17th of October, regardless of their time wasting letters! file your claim on line (Money claim on line).....it's very simple, even I did it!!! lol

Virus from hell! Made worse i feel as i'm now a single parent so not allowed to get ill till next Friday!:sad:

 

Wish i knew where all the snot came from? my poor nose is so red i could freelance for Father Christmas at the moment!!!!

 

Next question is do i phone woman from rbs that wrote above letter & ask which letter shes replying to as in prelim or lba? and let her know that MY deadline is up on 17th October or give her a chance to look at my account? Already had "Fob off!" letter off Mr Mclean from prelim letter!

Hi Warah,

 

If you're on benefits and likely to be exempt from court fees then I think you need to file an N1 form in person at your local court, and apply for exemption at the same time.

 

Again templates are in the library for what to put etc but may take a few days to get your head round so you may want to look as soon as your feeling half alive again hun.

Half alive! at the moment i would just settle for being able to walk without legs/whole body aching! oh that & getting to sleep, staying asleep without waking up with snot pouring out of my nose.

 

Yeah i'm on benefits, so will take a wonder into Sale at some point & sort out court.

 

Will have a look at templates today, if nothing else the pretty patterns of all the words may lull me to sleep!

Don't need a hand at the mo, just a new nose will do!

 

Where abouts in Withington do you work? up that way next week taking my friend to hospital for a check up. If i'm still full of cold they may put me in quarantine HOPEFULLY!

Well i got another letter off RBS this morning, offering £2123.00 as full & final settlement!:rolleyes: As it stands at the moment my total charges are at £4646.00:o so as you can guess i'm just about to send them MY FOB OFF LETTER:grin:

 

Will keep you all posted on outcome

 

Any words of advice greatly welcomed at this stage!

It's oh so tempting to take the money isn't it! but if you can hold out then do it. Tell them you'll accept it as a part payment and you will be pursuing the rest through Court if needs be. I don't know if you'll be in for a long wait or not, it seems that RBS has PMS at the moment....no continuity of mood! but if you are prepared, then soldier on;) I'm weary now, from dpa to now it's been about 5 months......getting twitchy as it's getting near to Christmas and I've still not got a whiff of a Court date.

 

I hope they settle quickly with you, if you are prepared to strike a deal then I suppose it'll be that much quicker.....but don't give them too much back! remember, you will get it ALL in the end but it just depends on if you can wait.

Yes, it was very tempting but resist i have:grin: Sending rejection letter off tomorrow. Do i need to send off another schedule of charges as obviously more have been added since 1st letter?

 

Hope you hear something soon, can't even begin to imagine how you must be feeling seeing all us "NEWBIES" getting quick responces! I know how i would feel! Just can't understand why you, Big Col etc are still waiting after so long:(

 

Will keep my fingers crossed for you all & will keep you updated on my situation.

 

However if in 5 months time i'm still waiting:mad:

Hi all,

 

Just to update, received a letter off Mr Mclean this morning for £3,920.00 as full & final.

Problem is at the moment i thought they owed somewhere in the region of £4,700.00 BUT in going through my statements again i realised they have already refunded to me £803.38 which brings total to £3,896.62

 

I'm stuffed aren't I??????

 

Can i request payment by cheque?

 

Any advice anyone

So, they have already refunded £800 odd into your account, and that is £800 odd of the £4,700 you are claiming for? In which case what he is offering you is the full amount? Have I go this right?

 

I think you can only ask for a cheque if the account is closed....I think.
