    • if i remember rightly, long ago in one of the first drafts of the old proposed gov't overhauls, there was a listing of recommended 'charges' that inc wrong reg = £20. some PPC's implemented such changes in advance. then later as it looked increasing likely the new code was never going to be implemented after it's 1st review and another set of codes was to be debated they all quietly revert back .......... dx

Sorry what is the different between a default notice and a default cal marker? yes, i may try and work arrangements out with the OCs after the breathing space but I'll see my circumstances then thank you again for all your help and patience, I really appreciate it and apologies If i am too fast or repeating myself.
    • receiving a default NOTICE (forget simple default cal markers) does not mean it will get sold on... OC's very very rarely do court themselves.  if it does you would receive a Notice of Assignment from the debt buyer/DCA.  as for reduced payment if it remains with the OC and they issue a DN, no harm in trying but lets get all your ducks inline first. dx  
    • okay thanks do you know how long it will take for it to get to the DCA or could the OC try and issue a CCJ? even though it's unlikely also for example would the OC agree to a reduction and a small payment over a super lengthy period of time if agreed? Rather than go through chasing apologies again for all the questions, just trying to understand all the possible scenarios.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

first for a bit you may want to read my other thread but i cant post the link to it because i havent posted 10 times yet.

 

I am not sure which letter to use to claim back My PPI from MBNA or any other Charges for that matter. i still have the account no. but have no idea how much was paid as it was based on percentage of balance.

i'm pretty sure i qualify on the basis they never

i was not asked whether you had any other insurance which would cover the credit card

i was not told you could buy PPI elsewhere to cover the credit card.

Also when i went self employed when i rang they said i was still covered. but i believe that to be a load of tosh.

I am a bit wary of doing this as DCA VULTURES are circling and i dont want to make the situation worse. as i'm in the process of getting my CRA to know the full extent of my situation

 

a problem i also have is that i have no idea how much i paid in ppi as it was on a sliding scale dependant on the balance of the card.

 

Do i need to know how much i had paid or will the account no. suffice

which letter do i use

Also how can i prove that they said i would be covered when self employed as it was just a general call over 4 years ago and never realised until now how important it would be as evidence.

Hi

 

Your best bet would be to SAR the lender to get as many statements as you can.

 

You can then prepare a spreadsheet of claim. Also go along to the fos website and download a copy of the consumer questionnaire and complete it. When you have done a spreadsheet and the questionnaire you just send a copy of both to the lender with a brief letter requesting a refund. No template as such.

 

There is a template for SAR in the CAG library, the link to which is at the top of every CAG page in green. Cost is £10 and they will have 40 days to comply.

would i not have to give a reason why i want the SAR or a reason why i want a refund of my PPI. this credit card is around 12 years old what would happen if they dont have statements that go that far back. do i make an estimate of PPI paid out. i'm guessing i would be able to use the SAR for detailing unfair charges etc. is there a link to for addresses as i would need that of MBNA customer contact centre.

SAR can go to their registered office...send recorded so you can track receipt

Try calling the Insurance Services Dept on 0800 062621. They should have records of all PPI premium payments on the account.

thanks Suvin, i will give them a call. i'm still going through with the sar though as i think it will be pertinent to the dca issues I am having.

on anm another point can i still get this info offthem even i dont have an account with then anymore.

Hi

 

Sar will get you all the information they hold on you subject to them possibly bailking at the six year block as mentioned above. You might possibly have late payment fees/over limit fees which you can claim back so a SAR is going to be your best bet to get at the relevant information.

 

What are these DCA issues you are having?

 

As this account is old, does it feature on your CRA file and when was the last time you made a payment on it or acknowledged the debt in writing?

it would easier to post the link than write it all put again. just had a letter from brachers LLP advising they are going to legal proceeedings in 7 days again on behalf of Experto credite if i dont pay reiterating credit card killer is invalid etc. i am starting to brick my pants a bit here so a bit a of advice from a site team member would be most appreciated. have had these letters before but wife is really get stressed with it and its rubbing off on me.

OK I'm going to take a look at your other thread.

 

However, you should get that SAR off straight away because it is going to be best to have as much information/statements as you can get.

 

I see you were worried about whether a PPI and/or charges claim will go against you....no it won't....it was your money taken from you so you are right to get it back with interest.

Also...what exactly does the Brachers letter say?

 

I see you have been given good advice on your other thread.... have you actually sent off for the CRA file?

 

To avoid confusion let us use this thread for the PPI claim and the other one for the DCA issues.

 

We can cross link them if the need arises.

have done the SAR letter for both cards. i have a pre paid cash plus credit card i forgot i had so put some cash on that today so it will be on it tomorrow and i will get my CRA aswell tomorrow and post details minus personal info on other thread. will dig letter out on put info on other thread i dont have a scanner so will type it out.

Hi Jules,

don't panic as you have a point of principal here.

My dealings with MBNA went on for 14 months from their issue of claim to eventual settlement via two summary judgement hearings. My defence was always based on the PPI acting as a set off against the claim and I was incredibly

lucky with the DJ who took my side and gave a no order to costs, especially as they had messed me around for two years

blaming uncertainty of interest calculations on the PPI.

If you ever get the insurance t&c's it will say that being self employed you have to cease trading (i.e. notify IR, close accounts etc.)

I got back all my PPI from 1998 (12 years past) plus the contractual interest it cost me (more than the PPI itself) as well

as all late payment fees and overlimit fees. There were times I felt like it would finish me, even the local solicitor wanted me to settle for just the PPI, but I'm so pleased i found this site, read every MBNA thread and came out the other

side.

If you get an executed agreement and/or a valid DN they are bound to contain errors so don't hold your breath.

Any other advice keenly offered!

don't know if you've had the SAR responses as yet but don't expect them to go back more than 6 years ( its how they save themselves money) and don't accept a PPI settlement without checking

The interest yourself. There's plenty of helpers here with spreadsheet calculators to ensure you get what you deserve, including late and over limit fees.
