    • Documents arrived today dated 27th March.  This is a cc taken out a long time ago (2008) and they don't seem to have been able to provide a copy of a CCA agreement, just reams of print outs of lines of texts from old bank statements, default notices etc.   
    • Documents finally arrived today from PRA group.  New day have sent me lots of paperwork, copies of default letters and statements, print out of what looks like a CCA that would have been completed on online, IP address as signature.  This debt is not too old, so possible this is the true copy of agreement ?  Not sure what my defence would be beyond irresponsible lending. 
    • pers i wouldn't.. all you need to know is in the posts of that thread....that being section 127(3) of the CCA refers. if under a CCA return, the 'creditor' claims its a recon, it must not contain any details like a sig, tickbox, or typed name (whether you signed physically or by online tickbox) 1. those are not necessary in a recon, so why inc them? (faked??) 2, it cant thus be a recon!!, it must be a copy of the 'original' from the original creditor, not from a debt buyers filing cabinet. they shouldn't not be 'mixing' some original docs from the OC with crap from their filing cabinet, claiming its ALL a recon! because some of it is faked. just remember there are far more docs like NOA and a DN that are as equally important to a court claim of 'this debt is enforceable'. never rely solely upon the dodgy agreement argument.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone after a number of days having a good look around the PPI threads i am now ready to start a number of claims i will start seperate threads as i begin them.

 

I could do with a bit of help with this one first it was a car loan taken out in March 2002 for 48 months dealer is now no longer trading finance arranged with G E Capital Bank Ltd trading as

G E Custom Finance who i believe can be a bit difficult we paid off the car in Feb 2005 all previous payments were made on time and we were quoted a settlement figure of around 1400 which was then reduced to 623 when we enquired about handing back the car.

 

On the agreement we did not tick the box we were just told the repayments including the ppi.

 

Agreement is not clear it does not show how much the ppi is or how much interest is paid on it and there a lots of other reasons as well.

 

Is this company part of G E Money who would i send the claim to grateful for any help

I think you need to send the initial request for refund to the company who provided the finance/ppi.. Which I guess in this instance is GE Money.

I am not certain whether you would need to send a copy of the agreement with the claim form or not. I will ask someone to look in on you.

Is there any way you can scan in (minus personal details) the agreement and perhaps one of the PPI guys can work out the PPI for you. I have posted instructions on how to do that below.

Hmm, so they havent stated an amount the PPI would cost you overall. The only mention is at the bottom of the document where there are two separate costs for one with and one without.

 

Which amount were you paying each month ?

Thanks CitizenB here are the payments made 1st one of £190.97 on 30/04/2002 and then £115.97 on the 30th of each month until last one paid on 30/12/2004 for £115.97 and then we wrote to them asking for a settlement figure and we were quoted £1789.51 balance minus £124.93 rebate of charges minus £270.61 capital care rebate settlement amount of 1393.97 anyway after a bit of thought we were going to voluntarily treminate the agreement as we were in the process of getting a new car with black horse ( another ppi claim) so we phone up GE and they then offered us over the phone a figure of £623.54 which my mother law paid for us so we could keep the car and get rid of the finance.

Very odd looking agreement as regards the insurance goes. Looks like you were paying £19.33 per month for some type of insurance but it doesn't say what type.

 

Have you got any other documentation for this HP at all?

 

Even if it is not PPI, it is still an insurtance whoich could have been mis-sold and therefore reclaimed.

 

Do you have the written settlement statement when the account was finally closed and terminated?

Hi ims21 i will scan the bottom half of the agreement for you to have a look at the figures that i put up in post 6 about the settlement were sent to us in a letter in january 2005 and as we were not in a postion to pay this amount we then told them that we were going to hand the car back

(voluntariy terminate) and then they offered us a settlement figure of £623.54 as final settlement which was then paid but no breakdown as to how this amount was made up we also never received or saw the capital care booklet the last letter we got was on the 9 march 2005 certificate of completion but again no breakdown.

Hi

 

OK so its PPI then and if you didn't want it or request it then it has been put on the account without consent and has been mis-sold.

and grab the forst spreadsheet (StatIntV101.xls) and complete it listing the date of the payment, the description (i.e. "PPI Payment") and the amount of £19.33 for each normal payment you actually made.

 

As the payments would have stopped when you settled the loan and the entire premium wasn't added up front it would seem that this is just a regular payment PPI so you would stop the entries at the date you settled the account.

 

When you have completed the sheet, the green box at the top will give you a claim amount.

 

Go along to the fos website and download the consumer questionnaire and complete it.

 

Send a copy of your spreadsheet and the completed questionnaire to the lender together with a brief letter requesting the refund.

 

Lets see what they say.

ok received a letter back of GE Money saying that they will start an investigation into the concerns that i have raised but one query i have is where it says account number they have untraceable so after 8 weeks will they then send me a letter saying nothing to do with us and then i will have to go to the FOS or the FLA as it was for hp on a car.

Will wait and see

ok have had a letter back off GE Money basically saying that they are unable to locate an account on their systems and as they do not sufficient info to respond to my complaint they we be marking it closed on theie records.

 

If i have any new info that might enable them to locate an account i should send it to them i originally sent a covering letter and the spreadsheet and the fos questionairre i do have the agreement here should i resend all this again with a copy of the agreement.

So they are trying to wriggle then.

 

Yep send them a copy of the agreement and, if possible, a snapshot of the payments you have made.

 

Strong letter saying that it clear from this evidence that PPI was paid to them and you want it back.

Just some info for anyone else trying to get PPi of a GE Money agreement mine was for a hire purchase for a car. I have phoned up GE Money consumer lending after they said they could not find my agreement and have been told that the hire purchase (cars ) part of the business is now part of Santander consumer finance

Hi everyone just an update on this thread i wrote to Santander who now own the GE bit of motor finance and i got a reply back basically saying

 

''they have investigated my complaint fully and from the issues that i have raised and found as that the sale of the policy was conducted by the motor dealer from whom we bought the vehicle, it was their responsibility the ensure that the sale was handled correctly. Therefore any issue surrounding the slae of this product should be raised with them.

Whilst the dealer is responsible for addressing the complaint, we are concerned by allegatiuons of improper practices by any of our approved introducers and we have therefore noted your complain on our records for this dealer.

and they then go on to say if i am not happy with this response i can refer the matter to the fla or the ombudsman within 6 months of the date of this letter.

 

So could do with some advice please i think i would probably be best just to go straight to the ombudsman however it does not state that this is their final reply they had my complaint letter, fos questionairre and spreadsheet only 5 working days before i got the reply above so i think it may be a standard get lost letter.

 

Would be grateful for advice.

On a regulated agreement their "approved Introducer" acts as their agent and S56 of the Consumer Credit Act could be helpful to you by challenging them yourself in the first place.

 

If your agreement is regulated tell them that you will be using S56 if this goes further and it squarely puts them in the frame for the conduct of their agent/broker. You can also tell them that should you need to take this further you will be backing your complaint up with this whether it be to fos or via the courts.
